TM 90, Parcel 6B6 is zoned R-1, Residential. Request is to reduce the side setback from 15 to 12
feet to allow an addition to the house.\glr\
DESCRIPTION OF REQUEST:
Request of variance of sideline building setback involving a triangular area
of 2.5 feet by 12 feet. (See attached drawing and plats. )
JUSTIFICATION SHALL BE BASED ON THESE THREE (3) CRITERIA:
1) That the strict application of this ordinance would produce
undue hardship.
Staying within setback would allow for window space on only one wall.
2) That such hardship is not shared generally by other properties
in the same zoning district and the same vicinity.
This situation does not relate to other neighborhood properties.
3) That the authorization of such variance will not be of
substantial detriment to adjacent property and that the
character of the district will not be changed by the granting
of the variance.
Adjacent property owners agree that this variance would not be a detriment
to their property. (See attached letter.)
The application may be deferred by the staff or the Board of
Zoning Appeals, if sufficient information necessary to this review
has not be submitted by the deadline.
