HomeMy WebLinkAboutLOD202100018 Action Letter 2021-09-24�qoF ntg 401 McIntire Road, North Wing c Z, Charlottesville, VA22902-4579 County of Albemarle Telephone:434-296-5832 COMMUNITY DEVELOPMENT DEPARTMENT WWW.ALBEMARLE.ORG September 24, 2021 RE: LOD2021-00018 - OFFICIAL DETERMINATION OF SPECIAL USE PERMIT CONDITION COMPLIANCE — Compliance with Condition #2 of SP1990-00103 Orchard Acres (the "SP") — Parcel ID 055CO-03-00-OOA00 (the "Property") (Property of STANLEY MARTIN COMPANIES LLC) White Hall Magisterial District To Whom it May Concern: In response to the Planning Divisions request for an official determination of Condition #2 of the SP, to determine what is considered "development of the residue" of Parcel ID 055CO-03-00-OOA00, I have made the following determination: On June 19, 1991, the Albemarle County Board of Supervisors approved the SP to allow a floodplain crossing over Powells Creek. The SP includes the following condition, "No development of the residue property or access to adjacent properties is allowed until second access is provided to Orchard Drive." The residue is identified as Parcel ID 055CO-03-00-OOA00. Per LOD2014-00009, Boundary Line Adjustments (BLA) are not considered development of the residue; thus, the BLAB were permitted to be approved and subsequently recorded with the Office Clerk of the Circuit Court of Albemarle County. BLAB in 2015 and 2020 adjusted the boundary lines of the Property. The Zoning Ordinance defines development for the purposes of parcels being in a dam inundation zone and the floodplain. Even though the Property is in a dam inundation zone, Condition #2 at the time did not contemplate this definition. That said, this definition is being utilized for this determination. The second part of the definition regarding the floodplain will help guide this determination as well. The noted portion of the definition of "Development' is as follows: "..."development" means any man-made change to improved or unimproved real estate, including, but not limited to, buildings or other structures, mining, dredging, filling, grading, paving, excavation or drilling operations or storage of equipment or materials." The Zoning Ordinance also defines "Start of construction." "Start of construction means the date the building permit was issued, provided the actual start of construction, repair, reconstruction, rehabilitation, addition, placement, substantial improvement or other improvement..." In 1992, the Property was left as a 25.525-acre parcel after the subdivision that followed the approval of the SP. In 2015, the boundary lines of the Property were adjusted that left a residue of 12.8 acres. In 2019, a new survey was produced that identified that the Property was 12.810 acres. In 2019, a BLA was approved and recorded added land to the original 12.810 acres to become a 16.278-acre parcel. This parcel is the remaining portion of the original 25.252-acre residue from 1992. September 24, 2021 LOD2021-00018 Page 2 After consultation with Planning Staff and the Zoning Administrator, I have determined the following: The installation of the streets for the proposed Pleasant Green subdivision does involve grading. Grading is listed in the definition above that is being used for this determination. As these streets will provide access to existing public streets for the proposed Pleasant Green subdivision and the existing Orchard Acres subdivision, said grading would not be considered development as Condition #2 requires constructing a second access to Orchard Drive and that construction requires grading. Also, "development of the residue" specific to Condition #2 of the SP is issuing a building permit. The attachment titled "Development line for SP Condition" shows an interpretation of what lots proposed to be developed would and would not be subject to Condition #2 of the SP. This will allow lots within the Pleasant Green subdivision to the east of the blue line on the referenced attachment to be developed and not be subject to Condition #2 of the SP, allowing for the Pleasant Green subdivision's orderly development. The connection to Orchard Drive will need to be determined to be ready for acceptance into the State road system before the remaining portion of the proposed development to the west of the blue line in the attachment titled "Development line for SP Condition" will be permitted to have building permits issued. Anyone aggrieved by this determination may appeal it within thirty (30) days of this notice, in accordance with Virginia Code § 15.2-2311. If a timely appeal is not filed, this determination becomes final and unappealable. An appeal may be taken only by filing an appeal application with the Zoning Administrator and the Board of Zoning Appeals, in accordance with § 34.3 of the Zoning Ordinance, along with a fee of $240 plus the actual cost of advertising the appeal for a public hearing. Applications for Appeal of the Zoning Administrator's Determination are available at the Community Development Department located at 401 McIntire Road, Charlottesville, Virginia 22902, or online here for Zoning Administrator Determination or Appeal. This form applies to the appeal of the Zoning Administrator's decision or any other administrative officer pertaining to the Zoning Ordinance.
