The application for the above referenced project has been reviewed. Staff has reviewed the information
submitted in your original application packet and the supplemental information you submitted on
September 15, 2021. The information you submitted on September 151 was included in the original
application. (The information you submitted in the original application is attached to this letter.)
The application for SUB 2021-112 Damon Road is denied.
This denial is based on the following:
Sheet 1— Plat titled "Plat of Subdivision Showine Parcels X, Y & Z Portions of Tax Map 126,
Parcel 21" and dated July 20, 2016
This plat shows Tax Map 126, Parcel 21 C as currently shown on the Albemarle County Tax Map (see
attached) and as described in LOD 2017-08. (see attached) There are no apparent changes to the parcel as
it currently exists and therefore, no action is required by the County.
If a subdivision of this parcel is proposed it must be submitted as a separate application from the parcels
shown on either sheet 1 or sheet 3.
Sheet 2 — Plat titled "Sketch 33.146 acres total'. This plat is prepared by Dickerson Surveyina LLC
and is undated.
This plat appears to show the subdivision of Tax Map 126, Parcels 21E3, 21E4 and 21D2. This plat
appears to create new parcels and does not meet the definition of a boundary line adjustment as contained
in Chapter 14, Section 106 of the Code of Albemarle.
This plat does not contain any of the required information for a boundary line adjustment plat, Chapter
14, Section 208.1 of the Code of Albemarle, other than the required application fee. If this was intended
as a subdivision plat it does not meet any of the requirements of Chapter 14, Section 206 of the Code of
Albemarle.
Subdivision of these parcels must be submitted as a separate application from the parcels shown on either
sheet 2 or sheet 3.
Sheet 3 — Plat titled "Preliminary". This plat has no date, and no author is identified.

This plat contains insufficient information to allow any review to occur.
This plat does not contain any of the required information required by Chapter 14, Section 208.1 of the
Code of Albemarle.
Subdivision of these parcels must be submitted as a separate application from the parcels shown on either
sheet 1 or sheet 2.
You may submit revisions to address the comments above as provided for in Chapter 14, Section 222 of
the Code of Albemarle. If revisions are not received within 15 days, the plat shall be deemed to be
disapproved and a new application and fee shall be required for submittal of the plat.
The disapproval of the plat may be appealed as provided for in Chapter 14, Section 223 of the Code of
Albemarle.

0.5-acre parcel is determined to be a parcel of record as defined tin section 10.3.
The most recent deed for the 4.33-acre parcel reccrded prior to the date of adoption ct
the Albenarb County Zcrning Ordnance (December 10. 1980) is recorded in Deed
Pod- 602, page 225- This deed. dated August 9. 1976. conveyed three parcels of land
from the Georgia Marble Company to MGchell O. Carr, party of the second part and S.

Industrial DEoelopment Authcrity of Neiscn County to S. Vance Mkins, Jr. Among
these tracts was Parcel 7. described, in part. as containing 0.5 acres and being the
same land as was conveyed by the deed of record in Lucid book 135, page 331 arrd
Parcel 8, descrbed, in part. as containing 4.33 acres and beinq the same land as was
conveyed by the deed of raccrd in Deed bock 135. page 330. This transactlon had n+o
effect on the legal status or development rights of these two parcels.
The applicant has noted that these two parcels are shown as part of Parcel 21. owned
by Mitchel Carr but were acquired by S. Vance Wilkins by Deed Book 759, page 23.
This ci screpancy has no effect on this determination. We understand that this matter is
