McCulley,Zoning Administrator RE: VA-98-18 Greg&Helen Hudson T/A Cismont Market DATE: August 26, 1998 As a result of a State mandate, the underground fuel tanks are being replaced. This is mandated and may be done without a variance. However, any shift in the fuel pumps or addition such as the canopy, require the variance. They are shifting the pumps and replacing them with a computerized system. As a part of the construction project, they intend to erect the canopy. It is the applicant's opinion that for their business to be viable, they must sell a national brand. In addition, a national brand will invest in these upgrades. The applicants have stated that the fuel providers will absolutely not make the investment without a canopy. In summary, the applicants claim a national brand and a canopy addition are necessary. This item was deferred from your August 4th meeting per the applicant's request. Since that date,the applicant has heard comments from neighbors, staff and the Architectural Review Board. The Hudsons submitted photographs which show existing conditions at Cismont Market and the canopy at Shadwell Market. The Shadwell Citgo canopy is shown to illustrate the approximate size of the canopy proposed. Since the staff report was written,the applicants have chosen to stay with Exxon brand fuel. The applicant's proposal is to further decrease the amount of signage;however,the accurate size is not known at this time. The applicants have reviewed several options, including shifting the canopy and/or reducing its size. In response to the point that any addition must be compatible with the historical context,they have contacted their fuel distributor to discuss customizing the canopy. Customizing the canopy would allow the use of color,materials and design that are appropriate to this site and may not be the trade mark standards. The applicants have not been successful in receiving this approval to customize. In addition to photographs,a booklet was submitted which provides further justification for the vanance and which includes a copy of a petition signed by 512 people. It remains staff's position that a canopy is not necessary for reasonable use of the property. Staff maintains the position that any discretionary action such as a variance should consider the historical context of the area. We therefore continue to recommend denial. If the Board finds cause for approval,we recommend the same conditions of approval. Post Office Box 910 Orange, Virginia 22960 August 10, 1998 Re: Cismont Market Canopy Dear Mr. Stanley: Thank you for meeting with the neighborhood and explaining your reasons for requesting a location variance for a canopy on the Cismont Market. This letter will serve to list our concerns if a canopy is erected in the location and reflecting the design that you have submitted to Albemarle County for their review and approval. Location Route 22 and 231 move a high volume of vehicles at high speeds. There are numerous accidents on this twisting,turning,hilly road. Because of this,the canopy placed within a foot of the right of way creates a visual and possible physical obstruction on this curve. To our knowledge,at least one truck has found its way onto the site,not quite making the curve and nearly running into the pumps. Over the years the neighborhood has contacted the Virginia Department of Transportation and suggested reducing the speed limit from 55 miles per hour to a safer 35 miles per hour as the traffic moves through the villages along the 22/231 corridor. However, VDoT has not lowered the speed limit along the corridor and it remains legal to travel at 55 miles per hour. For safety reasons, and because of the visual prominence of the canopy in your current proposal, our prior discussion with you included amending your application: • to move the canopy further from the road, • to shorten the width of the canopy(distance from the building to the canopy), • to eliminate the plan to construct two lanes adjacent to the building, • to remove the 3 foot planting bed and • to move the handicap access ramp to the side entrance of the building Design The canopy design you have proposed does not fit the character of the area. • The 22/231 corridor has been designated as a Virginia Byway by the Commonwealth and they are shown as such on the official state road map. • The Southwest Mountains Historic District surrounds the site. This 30,000 acre district is recognized as a Virginia Historic Landmark and is on the National Register of Historic Places. • The landowners within this district and some adjacent to the site have placed thousands of acres under permanent easement, assuring that this area will remain undeveloped. • The canopy and any other site improvements should relate to the character of the area by: 1. Limiting its sire, 2. Relating the design of the canopy to the design of the existing building, 3. Using building materials that complement the materials on the existing building,they should be materials that are indigenous to the area, and are commonly used within the district. 4. Limiting the number of fixtures and the intensity of the lighting proposed on the site, this should include the canopy lighting,the parking area lighting,the lighting on the signs and any other internally or externally lit objects on the site, Several examples of possible canopy concepts conceived by preeminent architect Mr.Henry Browne are attached. Mr. iBrowne's reputation as an expert in historic building renovation and modern building design is known country wide, His sketches reflect a more historically sensitive and site responsive approach to canopy design_ If all parties agree conceptionally, Mr.Browne has offered to provide drawings pro bono Texaco has very faithfully reflected the character of the area in other locations throughout the country. It is important to our community that we not reflect the character of any interstate road way,an urban or suburban setting. A rural historic district is one type of district recognized for listing in the National Register of Historic Places. The National Register of Historic Places is the official list of the Nation's cultural resources worthy of protection. Southwest Mountains Rural Historic District is the second largest district in Virginia. Located in Virginia's central Piedmont region and running along both sides of the Southwest Mountains range, the Southwest Mountains Rural Kai Imhoff Historic District encompasses approximately 31, 975 acres of northeastern Albemarle County. The Southwest Mountains Rural Historic District is a Reginald keel remarkably unaltered and picturesque rural area. It has significant Anne M Thompson IdminuvmivrAanirnnl associations with historical figures in local, state, and national history; its historic buildings and structures retain considerable integrity; and its rural landscape has remained relatively unchanged despite recent development in surrounding areas. The district contains a broad range of eighteenth-and nineteenth-century architecture as well as early twentieth-century estates with grand manor houses evocative of the district's earlier history. Small rural settlements, each dominated by a railroad depot or country store, as well as more modest farms and rural lots where the traditional I-house or a bungalow The Southwest Mountains Rural Historic District is listed on both the Virginia Landmarks Register and the National Register of Historic Places. It contains over 30,000 acres, and hundreds of historic buildings including one of the oldest houses in Albemarle County, a school where Thomas Jefferson, James Madison and James Monroe were educated, several old mills, plantation complexes complete with dependencies and a host of important agricultural buildings. Given the pace of development in Albemarle, few places will remain rural over the next few decades. This may be one of those places, thanks to the stewardship of landowners who have given up permanently most of their development potential. Thousands of acres have been placed under conservation easement in the Southwest Mountains Rural Historic District and more easements are in the pipeline. This protected landscape has been and will continue to be one of Aibemarle's chief economic assets. Monticello, Montpelier and the 100,000-acre Rural Historic District linking them is becoming an international tourist attraction. That means more business for the Cismont Market and more gasoline sales for Texaco. We urge Texaco to work with local residents and design a canopy which is compatible with the historic structures and rural landscape of the Southwest Mountains Rural Historic District. We question the wisdom of moving the dispensers and a canopy of whatever size any closer to this heavily traveled, curving road than the existing dispensers already are. If a canopy cannot be designed which protects the safety of the public and the character of this rural historic district, then this site should remain as it has for years--without a canopy. Stanley, President Stanley Petroleum Products, inc. • Post Office Box 910 Orange, Virginia 22960 Dear Mr. Stanley: We have reviewed Texaco's plans to place a canopy and new gasoline dispensers at the Cismont Store and find the design to be incompatible with the character of this area. This area is one of the most scenic and historic places in the country. The property in question lies along a Virginia Byway, in a rural historic district listed on both the Virginia Landmarks Register and the National Register of Historic Places and near thousands of acres protected by permanent conservation easements. The Piedmont Environmental Council (PEC) has worked for years to insure the protection of this significant landscape. With the support of residents and local government, PEC successfully petitioned the Commonwealth Transportation Board to designate Rt. 22/231 a Virginia Byway in 1986. A report prepared by the Virginia Department of Conservation and Historic Resources supported the designation, noting: Perhaps no other area in Piedmont Virginia has such a rich historical background as does eastern Albemarle and southern Orange counties. The region has been the home of two presidents as well as a dozen or more former governors, legislators, statesmen and other notable individuals from the pages of Virginia's and the nation's history. Route 22/231 has been one of the common threads that have tied all the various elements together. In 1994, Scenic America, a national organization headquartered in Washington, D.C., named Route 231 from Cismont to Sperryville one of America's Ten Most Outstanding Scenic Byways. A press release circulated by Scenic America praises the byways "inspiring visiled farmland, architecturalpicturesque character." landscapes, and towns and villages with 19th century In 1989, PEC completed a study of the Southwest Mountains area and recommended that it be designated a rural historic district. Post Office Box 910 Orange, Virginia 22960 Dear Mr. Stanley: We believe it is the responsibility of everyone owning land and doing business in the Southwest Mountains Rural Historic District to work together to protect this special place, an area Thomas Jefferson referred to as "the Eden of the United States." We are doing our part. We have given up most of the development potential on thousands of acres we own in the District, much of it along Virginia Byway 22/231. We have committed our land to farming, forestry and open space, not just for a decade or two, but for all time. We carried out this commitment by placing permanent conservation easements on our property. The attached maps show colored in green the land placed under easement in this area. In many cases, these properties can be subdivided into parcels no less than 100 acres in size. Commercial development is strictly prohibited. We have dedicated these easements to the Virginia Outdoors Foundation which will insure the land remains protected as it passes through the hands of future owners. This is one of the very few places in the country where landowners have made this level of commitment to conservation. Thanks to these easements, this scenic and historic landscape will remain unaltered for the enjoyment and edification of future generations of Virginians. We ask that you respect this commitment in your plans for the Cismont Market. We have reviewed the canopy and signs you are proposing and find them more suited to a busy urban corridor than to this scenic rural byway. The Cismont Market is a good neighbor and provides a service to the local community. We would like to be able to support their perceived need for a canopy and are confident that Texaco has the resources to design a canopyad hetch will complement the landscape, the hundreds ofnearby historic buildings in architecture of the existing store the Southwest Mountains Rural Historic District. Post Office Box 910 Orange, Virginia 22960 August 10, 1998 Re: Cismont Market Canopy Dear Mr. Stanley: Thank you for meeting with the neighborhood and explaining your reasons for requesting a location variance for a canopy on the Cismont Market. This letter will serve to list our concerns if a canopy is erected in the location and reflecting the design that you have submitted to Albemarle County for their review and approval. Location Route 22 and 231 move a high volume of vehicles at high speeds. There are numerous accidents on this twisting,turning,hilly road. Because of this,the canopy placed within a foot of the right of way creates a visual and possible physical obstruction on this curve. To our knowledge,at least one truck has found its way onto the site,not quite making the curve and nearly running into the pumps. Over the years the neighborhood has contacted the Virginia Department of Transportation and suggested reducing the speed limit from 55 miles per hour to a safer 35 miles per hour as the traffic moves through the villages along the 22/231 corridor. However, VDoT has not lowered the speed limit along the corridor and it remains legal to travel at 55 miles per hour. For safety reasons, and because of the visual prominence of the canopy in your current proposal, our prior discussion with you included amending your application: • to move the canopy further from the road, • to shorten the width of the canopy(distance from the building to the canopy), • to eliminate the plan to construct two lanes adjacent to the building, • to remove the 3 foot planting bed and • to move the handicap access ramp to the side entrance of the building. Pesign The canopy design you have proposed does not fit the character of the area. • The 22/231 corridor has been designated as a Virginia Byway by the Commonwealth and they are shown as such on the official state road map. • The Southwest Mountains Historic District surrounds the site. This 30,000 acre district is recognized as a Virginia Historic Landmark and is on the National Register of Historic Places. • The landowners within this district and some adjacent to the site have placed thousands of acres under permanent easement, assuring that this area will remain undeveloped. • The canopy and any other site improvements should relate to the character of the area by- 1 Limiting its size, 2, Relating the design of the canopy to the design of the existing building, 3 Using building materials that complement the materials on the existing building,they should be materials that are indigenous to the area, and are commonly used within the district, 4. Limiting the number of fixtures and the intensity of the lighting proposed on the site, this should include the canopy lighting,the parking area lighting,the lighting on the signs and any other internally or externally lit objects on the site, Several examples of possible canopy concepts conceived by preeminent architect Mr,Henry Browne are attached. Mr. Browne's reputation as an expert in historic building renovation and modern building design is known country wide. His sketches reflect a more historically sensitive and site responsive approach to canopy design If all parties agree conceptionally,Mr.Browne has offered to provide drawings pro bono Texaco has very faithfully reflected the character of the area in other locations throughout the country. It is important to our community that we not reflect the character of an interstate road way,an urban or suburban setting. We are doing our part. We have given up most of the development potential on thousands of acres we own in the District, much of it along Virginia Byway 22/231. We have committed our land to farming, forestry and open space, not just for a decade or two, but for all time. We carried out this commitment by placing permanent conservation easements on our property. The attached maps show colored in green the land placed under easement in this area. In many cases, these properties can be subdivided into parcels no less than 100 acres in size. Commercial development is strictly prohibited. We have dedicated these easements to the Virginia Outdoors Foundation which will insure the land remains protected as it passes through the hands of future owners. This is one of the very few places in the country where landowners have made this level of commitment to conservation. Thanks to these easements, this scenic and historic landscape will remain unaltered for the enjoyment and edification of future generations of Virginians. We ask that you respect this commitment in your plans for the Cismont Market. We have reviewed the canopy and signs you are proposing and find them more suited to a busy urban corridor than to this scenic rural byway. The Cismont Market is a good neighbor and provides a service to the local community. We would like to be able to support their perceived need for a canopy and are confident that Texaco has the resources to design a canopy which will complement the landscape, the architecture of the existing store and the hundreds of nearby historic buildings in the Southwest Mountains Rural Historic District. We urge you to consider the safety of the road-travelling public in your design as well. We are very concerned about the proximity of the proposed pumps and canopy to Route 22/231, given the increasing volume of truck traffic, high speed limit and bends in the road to the north and south of this site. Moving the pumps closer and placing a structure of any size, let alone one as large as the proposed canopy, just one foot from the right-of-way seems an invitation to disaster. Post Office Box 910 Orange, Virginia 22960 Dear Mr. Stanley: We have reviewed Texaco's plans to place a canopy and new gasoline dispensers at the Cismont Store and find the design to be incompatible with the character of this area. This area is one of the most scenic and historic places in the country. The property in question lies along a Virginia Byway, in a rural historic district listed on both the Virginia Landmarks Register and the National Register of Historic Places and near thousands of acres protected by permanent conservation easements. The Piedmont Environmental Council (PEC) has worked for years to insure the protection of this significant landscape. With the support of residents and local government, PEC successfully petitioned the Commonwealth Transportation Board to designate Rt. 22/231 a Virginia Byway in 1986. A report prepared by the Virginia Department of Conservation and Historic Resources supported the designation, noting: Perhaps no other area in Piedmont Virginia has such a rich historical background as does eastern Albemarle and southern Orange counties. The region has been the home of two presidents as well as a dozen or more former governors, legislators, statesmen and other notable individuals from the pages of Virginia's and the nation's history. Route 22/231 has been one of the common threads that have tied all the various elements together. in 1994, Scenic America, a national organization headquartered in Washington, D.C., named Route 231 from Cismont to Sperryville one of America's Ten Most Outstanding Scenic Byways. A press release circulated by Scenic America praises the byway's "inspiring views of unspoiled farmland, picturesque historic landscapes, and towns and villages with 19th century architectural character." In 1989, PEC completed a study of the Southwest Mountains area and recommended that it be designated a rural historic district. That recommendation became reality in 1991, duo primarily to the dedication and support of area residents. The Southwest Mountains Rural Historic District is listed on both the Virginia Landmarks Register and the National Register of Historic Places. It contains over 30,000 acres, and hundreds of historic buildings including one of the oldest houses in Albemarle County, a school where Thomas Jefferson, James Madison and James Monroe were educated, several old mills, plantation complexes complete with dependencies and a host of important agricultural buildings. Given the pace of development in Albemarle, few places will remain rural over the next few decades. This may be one of those places, thanks to the stewardship of landowners who have given up permanently most of their development potential. Thousands of acres have been placed under conservation easement in the Southwest Mountains Rural Historic District and more easements are in the pipeline. This protected landscape has been and will continue to be one of Albemarle's chief economic assets. Monticello, Montpelier and the 100,000-acre Rural Historic District linking them is becoming an international tourist attraction. That means more business for the Cismont Market and more gasoline sales for Texaco. We urge Texaco to work with local residents and design a canopy which is compatible with the historic structures and rural landscape of the Southwest Mountains Rural Historic District. We question the wisdom of moving the dispensers and a canopy of whatever size any closer to this heavily traveled, curving road than the existing dispensers already are. If a canopy cannot be designed which protects the safety of the public and the character of this rural historic district, then this site should remain as it has for years--without a canopy. Early road corridors, and curving country lane shaded by alleys of towering cedars and mature deciduous trees,together with fields delineated by old fence and cedar lines enhance the integrity of the district. The district has strong associations with several of the nation's early intellectual and political figures--including Thomas Jefferson,James Madison, Thomas Mann Randolph, and Nicholas Meriwether--who lived in or near the district and who maintained social, family, and business ties to the district residents. In addition the district has strong linkages with the adjacent Madison-Barbour Rural Historic District(which extends for a forty square mile area from the Orange-Albemarle line north to the town of Orange). The Southwest Mountains district serves as a geographic link between the historic residences of former United States presidents and friends Thomas Jefferson(Monticello)and James Madison(Montpelier in Madison-Barbour District) and lies partially within Monticello's viewshed. Together the two districts represent not only the broad influence of Madison and Jefferson on their agrarian society but also reflect the Virginia plantation legacy that survives in the many large estates and horse farms that still exist in the district. ' .0%4 •..k 140., ice ONT ` MARKET do DELI Monday, August 03, 1998 Dear Staff and Board of Zoning Appeals, Cismont Market & Deli is currently seeking zoning approval for the addition of a canopy and a change in existing signs. It is our opinion that both would be improvements over the existing structures and would most importantly provide our customers with improved safety and shelter. In this letter we would like to address 3 main issues we feel will help clarify why your approval is so critical to our business. First we will discuss the reason for requesting the approval to add a canopy. Second, we will explain why we have chosen the Texaco canopy and why we want to request l foot variance. And finally, we will review our progress with the ARB and the proposed plans. The reason we are requesting approval to add a canopy is primarily to provide a much safer and convenient option for customers to pump gasoline. Here are some of the benefits our customers will have: *option to pay at the pump - traveling parents will be able leave their children in their car while paying at the pumps. *customers will feel safe and secure with the canopy shelter during dark hours and bad weather. *fast and convenient service without waiting in lines to pay. *most importantly - our petition with 512 signatures tells us that they approve and desire this addition. *three grades of gasoline - regular, unleaded, and supreme. (currently our mid-grade is out of service due to a leak) Texaco is willing to invest in a canopy, new pumps including 3 grades of gasoline plus Diesel. also a system that will monitor gas levels automatically, and a new computerized register system. They are willing to provide our business with these upgrades even though we do not actually sell the volume of gasoline most stores with canopies do. The reason they are willing to invest in our business is because it is proven that stores with canopies do more gasoline business than stores without. (It is important to note that this store has had a canopy in the past). We need a national brand of gasoline to attract customers. Our petition supports that our customers demand quality gasoline. No national brand companies are willing to invest in upgrade assistance without allowing a canopy. Another critical aspect of this process is our desire to remove and replace the leaking tank as quickly as possible. Department of Environmental Quality is involved in our process to remove the one tank that has had a leak but is now under control. We desire to address all issues at once to insure the least amount of disruption to our customers and our business. Our second issue to cover is the choice of the Texaco canopy and why we propose a 1 foot variance. We have addressed earlier that Texaco is willing to invest in numerous upgrades to win our business because they know we can grow our sales of gasoline with the addition of a canopy. Currently the pump island area is positioned very close to the store. (Please see the attached drawing numbered page 2). We desire to move the island to the right so that the right side is flush with the right side of our building and we plan to position the island so that vehicles will have equal room on both sides and allow for safety of customers walking in and out of the front entrance. (See page 3 drawing that shows where we propose to put the canopy). Another reason for placing the canopy to the right of where the pumps currently are located is to help our cashiers see customers while they are at the pumps. We have had some problems with gasoline theft. This proposed location is the best location for safety, traffic flow and control of theft. Finally, we want to address our progress with the ARB. We will list the agreements we have so far: 1- Canopy fascia will not exceed 3'8" including red band. 2- Star logos (2) will not be illuminated. 3- Dispensers will be Texaco spec colors and we propose the old style with the least amount of red, and 3'0" wide. 4- We agree to plant 15 Bradford pear trees 10 feet apart around the perimeters of the parking area. 5- We agree to add a wood fence around our dumpster. 6- See drawings of the canopy fascia, columns, dispensers on page attached numbered 4. 7- No changes will be made to the building exterior. 8- No gradation (red stripe) will be placed on the canopy fascia. 9- A photometric plan has been ordered from the lighting company. The total number of recessed lamps will be reduced and offset from the ROW, resulting in a plan that will meet the 0.5 foot-candle requirement. 10- A monument sign (8 x 4 ft.) will be installed in place of the existing 2 pole sign, as approved by Zoning. We propose to place this monument sign on the right side of the parking area (opposite side of where the existing Exxon sign is located) because it is a monument sign and will be low to the ground we feel it would be better identified on the opposite side of the lot. 11- Planters (2) will be added to pump island. 12- The most practical location for the canopy is as submitted on the attached drawing numbered 3. If the canopy is located on the north (Gordonsville) side of the store, access to the pump island through the northbound entrance will require excessive turning on the part of the customer (2 - 180 degree turns). If the canopy is located on the south (Shadwell) side of the store, the store operator will not have a direct line of sight from the checkout to the pump island. This will likely result in fuel theft at the island and would not be satisfactory from a store operations perspective. In either alternative case, additional grading and asphalting would be required to provide access to the pump island. 13- The overall height of the canopy (grade to decking) measured at the point of lowest clearance will not exceed 14'0" (standard is 14'6"). 14- A landscaping drawing is attached on page numbered 2. We are fast approaching the December 1998 deadline. We are told that if we do not have our tanks replaced by this deadline that we are subject to up to $2,000 penalty per day for pumping gasoline. If we do not get your approval today we could be forced out of business very soon. Any delays will have serious impact on meeting our deadline. We are told that once we receive approval from BZA and ARB and finally Planning, there will be a 2-1/2 month delay to get the equipment ordered and schedule contractors to begin the work. It also takes a minimum of 2 weeks to complete the project, which will mean business disruption due to construction traffic. We cannot afford any delays beyond the scheduled meeting here today and the meetings with ARB and Planning in the near future. Please grant approval for this addition today.
