Charlottesville, VA 22902 Re: Cisrnont Market Variance Request Dear Board Members and Staff, As a local landowner along the scenic by-way of US 22, I would like you to know that I support Cismont Market& Deli's request for a variance_ After viewing scale drawings and property plans, I can imagine no reason to oppose the variance. It is not as if they are destroying a historical building. Instead, they are trying to run a business, and are required to make intelligent business decisions. The business decision they have made, and that I support, is to install a reasonably sized canopy in conjunction with federally mandated tank upgrades. This is a decision that will avoid approximately$15,000 of extra spending by being able to coordinate the two projects. If you had the opportunity to save $15,000 of your family's budget what would you do? Denial of the variance would be an undue hardship that would border on criminal. Other gas stations on scenic highways in Albemarle County(Brownsville Market, Herringbones) have been given approval to build canopies and Cismont deserves the same right to conduct their business. Thank you for considering my opinion, and for your vote to approve Cisrriont Market& Deli's variance. Cismont Market has become a highly valued,and well established local business. Its presence in the community is important,and its ability to provide the community with improved facilities is a great benefit fox everyone. Who wouldn't want to be able to stay dry on a rainy day when you are pulling out of the driveway and the gas gauge is on"E"7 Who wouldn't warn to have a reputable national brand represent their local country gore? Reilly, property described as Tax Map 065, Parcel 12C, Zoned A-1 , located on Route 231 at the intersection of Route 231 with Route 22. The applicant requests relief from Section 2-3 of the Albemarle County Zoning Ordinance to allow a structure (addition) to be located 33 feet from the right-of-way of Route 231 , a variance of 42 feet. The present structure which is non-conforming was erected without a roof overhang on the front. The applicant wishes to build a fake mansard roof of which would extend four feet closer to the right-of- way of Route 231 . The front wall of the structure would not extend any closer to the road - only the roof line. The overhang portion of the roof is classified as part of the structure and setback are applied to such. Therefore, staff recommends approval . James Reilly, owner, was present to speak for the application. Mr. Reilly stated he had a square cinderblock building that needed to be dressed up. He stated that he only wanted to install a fake mansard roof that would be on the front and around the sides. The store is non-conforming as it has been on the site many years. The store will not be any closer than it is now. The overhang of the roof will be a few feet closer to the right-of-way. As there was no one else present to speak for or against the variance, the public hearing was closed for action by the Board. Mr. Roberson made a motion to grant the variance. Mr. Smith seconded the motion and the roll was called. Mr. Heath - Aye Mr. Kennedy - Aye Mr. Roberson - Aye Mr. Smith - Aye The variance was approved as requested. He stated if they went back the three feet necessary to meet the requirement of the ordinance, the line would be too close to the roof. It would have been too close to set the house with the crane without endangering the personnel setting it. He stated that when he first measured the setback, he thought he was right. He did not know that a building permit could be issued before zoning checked the setback. He stated he called the office the day before the footings were dug and was told the building permits had been issued so he thought everything was okay and that the setback was right. Note: Zoning previously checked the setback before the building permits were issued. Now the zoning is done at same time as the footing by the same inspector. After some discussion regarding the power line placement, the public hearing was closed for action by the board. Mr. Smith stated the whole situation would have been better if the house had been situated meeting the setback requirements. He stated he did not see a hardship and he felt that he needed more facts. He stated he would be more inclined to look favorable at the application after the power line was removed. Mr. Payne, Deputy County Attorney, stated that after the power line is removed, there would be not hardship. Mr. Pillow stated that he did have a problem with the septic system. He stated that he just barely had enough room without getting town into the flood plain and three feet would make it worse. Mr. Smith made a motion to grant the varance of three feet providing that the power line is moved and not to be over any portion of the house. First,let me state that their opposition is in no way a reflection of the majority of citizens and land owners who live and work in this area. I believe that Cismont Market&Deli should be afforded the opportunity to make and execute business decisions that are a benefit to the community. There is no doubt in my mind that the improvements being proposed by Cinnorut Market will. 1. Improve safety for c Stowers,travelers,and tourists. 2. Improve the appearance of the existing business 3. Increase the value of the business property,thus increasing the value of surrounding property. 4. Blend posciVely with the existing building and saurrous dings. 5. Reduce the need for mom development by increasing the capacity to accomodate a growing po-Mallon. 6. Enable a well respelled national brand to service a well known national historic district. 7. Provide tourists with a recognizable brand that welcomes them to stop and learn more about the area. As you can see,an attractive store and well recognized brand are beneficial to the community,the business.ness..and the image of the county itself. Mary Joy does have a parcel specific map illustrating the Southwest Mountains Historic District I have enclosed the study booklet,and hope it is helpful. Southwest Mountains Coalition Keswick, Virginia 22947 Board of Zoning Appeals County Office Building 401 McIntire Road Charlottesville, Virginia 2902 July 29, 1998 Re Cismont Store Canopy Variance Request Gentlemen_ The above noted request will have a negative effect on the character of the Southwest Mountains Historic District Many land owners along the Route 22/231 corridor have felt strongly enough about supporting the rural character of this area to place a considerable amount of land under easement. By creating conservation easements on their property they have attempted to preserve the rural character of the eastern portion of Albemarle County, Cloverhill, Castalia, Frampton and Kinloch all have conservation easements prohibiting future development. The 30,000 acres within the Southwest Mountains Historic District is on the National Register of Historic Places and has been designated as a Virginia Historic Landmark The Route 22/231 corridor has been designated as a Scenic By-Way and has been voted one of the most beautiful By-Ways in the nation. The applicant states that they are requesting the variance because they must comply with current environmental regulations Do the tanks have to be replaced in the same area? Would it be possible to place the tanks and the canopy on the side of the building? And if this is possible, can the canopy be designed to match the existing building Canopies that have been constructed in recent years seem to be used a beacons beckoning travelers along the roads. Can the lighting be limited to shine only on the site and not into the roadway or up into space? The application submitted will be a great visual intrusion on the by-way, and undermine the character of the area Because of the landowners commitment to conserving their land thereby providing the community with a highly traveled tourist route that reveals the essence of Rural Central Virginia, and because the Cismont Store lies within an area designated on the federal and state registers of historic places, we urge you to deny the request. This intrusion into the landscape can only destroy the beauty of this corridor that our neighborhood has worked so hard to preserve. A monument sign (8 by 4 ft . ) will be installed in place of the existing 2 pole sign, as approved by Zoning. I have discussed the other issues raised by the ARB in your July 23r letter and respond as follows : • 1 . Planters (2) will be added to the pump island. 2 . Dispensers will be installed that are 3 ' 0" wide . 3 . The most practical location for the canopy is as submitted on my drawing dated July 7, 1998 (attached) . If the canopy is located on the north (Gordonsville) side of the store, access to the P.O. Box 910 - 13032 James Madison Hwy. - Orange, VA 22960 • 540/672-2122 - Fax 540/672-2125 pump island through the northbound entrance will require excessive turning on the part of the customer (2 — 180 degree turns) . If the canopy is located on the south (Shadwell) side of the store, the store operator will not have a direct line of sight from the checkout to the pump island. This will likely result in fuel theft at the island and would not be satisfactory from a store operations perspective . In either alternative case, additional grading and asphalting would be required to provide access to the pump islands . 4 . The overall height of the canopy (grade to decking) measured at the point of lowest clearance will not exceed 14 ' 0" (standard is 14' 6" ) . 5 . Many land owners along the Route 22/231 corridor have felt strongly enough about supporting the rural character of this area to place a considerable amount of land under easement. By creating conservation easements on their property they have attempted to preserve the rural character of the eastern portion of Albemarle County. Cloverhill, Castalia, Frampton and Kinloch all have conservation easements prohibiting future development. The 30,000 acres within the Southwest Mountains Historic District is on the National Register of Historic Places and has been designated as a Virginia Historic Landmark. The Route 22/231 corridor has been designated as a Scenic By-Way and has been voted one of the most beautiful By-Ways in the nation. The applicant states that they are requesting the variance because they must comply with current environmental regulations. Do the tanks have to be replaced in the same area? Would it be possible to place the tanks and the canopy on the side of the building? And if this is possible, can the canopy be designed to match the existing building? Canopies that have been constructed in recent years seem to be used a beacons beckoning travelers along the roads. Can the lighting be limited to shine only on the site and not into the roadway or up into space? The application submitted will be a great visual intrusion on the by-way, and undermine the character of the area. Because of the landowners commitment to conserving their land thereby providing the community with a highly traveled tourist route that reveals the essence of Rural Central Virginia, and because the Cismont Store lies within an area designated on the federal and state registers of historic places, we urge you to deny the request . This intrusion into the landscape can only destroy the beauty of this corridor that our neighborhood has worked so hard to preserve. We are greatly concerned that the proposed canopy and signage would be detrimental to the scenic, rural character of the Cismont—Keswick area. Much effort has gone into creating and maintaining the rural character of the Southwest Mountains area where the proposed canopy and signage are to be located. The Southwest Mountains Historic District is on the National Register of historic places,is designated as a Virginia Historic Landmark,and the site of the proposed canopy and signage is on Routes 22 and 231,a designated Scenic—By—Way. Also the site of the proposed canopy and signage is located in the midst of some four thousand acres in the Cismont—Keswick area that are under conservation easement. Landowners of this area have willingly given permanent easements, giving up the development rights on their land in order to protect and enhance the rural character of the area. It seems incongruous to place a canopy and signage of this nature in an area where such effort has been excited to maintain the rural integrity. In closing we would like to express our approval of the appearance of the Cismont Store as it exists today. The efforts that the current store owners and operators have made to make their neighborhood enterprise attractive,pleasant and well run are appreciated by all. Many improvements to the store property have been made in the recent past that are an addition to the appearance of our community. We understand Mr. Hudson's position as a businessman and the need to replace the existing gas tanks, but the Cismont Store is a part of the rural community and would not even be allowed to exist as it is,under current zoning. Therefore,we believe that it is imperative that the design of any canopy and signage be in keeping with this landscape and the architecture of the existing store.
