Tax map 60 parcel 36 is zoned R1, Residential, with a pending rezoning to CO, Commercial Office. The request is to reduce setback for structures in commercial districts adjacent to residential districts from 50 to 26' to allow the property to be rezoned & have its structures conform. The 20' undisturbed buffer for parking adjacent to residential districts is also requested to be reduced from 20' to 0' to allow construction of a new travel aisle and parking area between the existing building and the adjacent parcel where there is now a shared driveway\qlr\ DESCRIPTION OF REQUEST: See Attachment 1: JUSTIFICATION SHALL BE BASED ON THESE THREE (3) CRITERIA: 1) That the strict application of this ordinance would produce undue hardship. I hereby certify that the information provided on this application and accompanying information is accurate, true and correct to the best of my knowledge and belief. ig ature ��..,L.(27 Date v Receipt# Date ATTACHMENT # 1 June 28, 1998 VARIANCE APPLICATION TAX MAP 60 PARCEL 36 Description of request: Request is made to reduce the building set-back to fifteen feet and eliminate the parking set-back from the south property line to permit the use of the existing stone house as an architects office. This request recognizes the existing site conditions and commercial nature of the surrounding buildings. The authorization of this variance will permit a use which is consistent with, and supports the Comprehensive Plan. Justification Criterion 1: That the strict application of this ordinance would produce undue hardship. Due to the existing location of the stone house strict application of this ordinance would produce undue hardship by prohibiting the use of this property because neither the house nor the property line can be moved to comply with the ordinance. Criterion 2: That such hardship is not shared generally by other properties in the same zoning district and the same vicinity. This hardship is not shared generally by other properties in the same zoning district and same vicinity. For example, the adjoining Teague Funeral Home does not comply with the set-back requirements, and therefore this hardship is not shared by other properties. Page 1 of 2 Criterion 3: That the authorization of such variance would not be of substantial detriment to adjacent property and that the character of the district will not be changed by granting the variance. The variance would cause no detriment to adjacent properties. An inspection of the existing conditions would indicate that the proposed site and parking layout permitted by this variance would serve to organize and structure the land use of the adjoining parcels which are presently loosely connected by a free-form gravel drive. The Owner of the affected adjacent parcel supports this variance request (See attached letter). It is also reasonable to expect that this adjoining property, the last remaining parcel also designated by the Comprehensive Plan for commercial use in this area, will eventually also seek rezoning to commercial. When this occurs, the set-back ordinances will be no longer relevant. In addition,please note that the parking arrangement indicated on the accompanying schematic site plan has not been fully thought through and some adjustments in the final parking layout should be expected.
