Box 5603 Charlottesville, VA 22905 RE: Board of Zoning Appeals Action VA-98-19 - Tax Map 060, Parcel 36 Dear Mr. Matthews: This letter is to inform you that your variance application, VA-98-19, was heard by the Albemarle County Board of Zoning Appeals on Tuesday, August 4, 1998. The Board ruled (3:2) to approve your variance request subject to the following conditions: 1) The variance is for the existing structure only. Any addition to or replacement of this structure and all new structures shall comply with the then existing ordinance or apply for a new variance. (This excludes replacement structures built under Section 6.6.1, and 2) The variance is conditioned on the property being rezoned to CO, Commercial Office. This variance allows relief from Section 21.7 to reduce setback for structures in commercial districts adjacent to residential districts from 50 to 26 feet to allow the property to be rezoned & have its structures conform. The 20 foot undisturbed buffer for parking adjacent to residential districts is also requested to be reduced from 20 feet to 0 to allow construction of a new travel aisle and parking area between the existing building and the adjacent parcel where there is now a shared driveway.
