1) That the strict application of this ordinance would produce
undue hardship.

DESCRIPTION OF REQUEST:
This request is in regard to a swimming pool which we propose to build for
use in the therapy and exercise we (wife's condition) require in the treatment of
scoliosis and related medical ailments. The proposed location of the pool is in
compliance with all zoning codes except for approximately 2% if its total size . The
portion of the pool which is out of compliance is a right triangle shape measuring
2'-9" by 16' at the north-east corner of the pool which oversteps a 75' setback.
JUSTIFICATION CRITERIA:
1. A vast portion of our property is very steeply sloped or in a flood plain. As
such, the location of our proposed pool was selected because it was the only
relatively flat land available throughout the entire property on which we could
build a pool without great difficulty. Within this limited flat area, we have taken
the most common sense approach to place the pool close to the house and align it
directly off the west wing of the house. The pool's close proximity to the house will
provide the ease of access that will be important in future years as the degenerative
effects of scoliosis evolve. Aligning the pool with the house makes for a well
designed arrangement of building parts on the land. To locate the pool other than
we have proposed would create hardship in ease of access and by degrading the
design value of the property.
2. We are un-aware of what hardships may have been encountered by other
properties in our area.
3. We are in a rural area with great spans of distance and view between
properties. Our property is located immediately next to route 250 W to the north.
The road bed sits down from our land approximately 20' below elevation of were the
pool would be located. Our property is bounded to the south by a distant creek. The
small request we are making (at the set back of 250 W) would not be perceptible, now
or in the event of future adjacent property development, without the aid of very
accurate and explicit surveyors markings on the property.
