Dear Ms. Perkins:
This letter is to inform you that your variance application, VA-98-27, was heard by the
Albemarle County Board of Zoning Appeals on Wednesday, November 4, 1998. The
Board ruled (5:0) to deny your request to reduce the front setback from 75 to 18 feet to
allow a new canopy to be constructed to the side of the expanded building. In a
separate motion, the Board ruled (5:0) to approve your request to reduce the front
setback from 75 to 27 feet to allow an addition on the side and rear of the store subject
to the following condition: 1 his variance is for the addition proposed in this file. Any
future additions closer than 75 feet to the right-of-way will require amendment to the
variance.
If you are aggrieved by this decision, you have a right to appeal the notice within thirty
days in accordance with Section 15.2-23111of the State Code, or the decision shall be
final and unappealable. Such appeal shall be taken within thirty days after the decision
appealed from by filing with the Circuit Court of Albemarle County a notice of appeal
specifying the grounds thereof.
