THIS DEED, made this 18th day of October, 1974, by and between
EDWARD L. SMITH and MARGARET M. SMITH, husband and wife, parties
of the first part and EDWARD L. SUTHERLAND and CORDELIA G.
SUTHERLAND, husband and wife, parties of the second part,
W ITN E S S ET H:
That for and in consideration of the sum of THIRTY-FIVE THOUSAND
AND NO/100 DOLLARS ($35, 000. 00) of which the sum of Seven Thousand and
N01100 Dollare,($7, 000. 00) is cash in hand paid to the parties of the first
part by the parties of the second part, the receipt of which Is hereby acknow-
ledged, and the balance of Twenty-eight Thousand and No/100 Dollars
($28, 000. 00) is evidenced by bonds of the parties of the second part secured
by a deferred purchase money deed of trust recorded contemporaneously
herewith as part of this transaction, the said parties of the first part do
hereby GRANT, BARGAIN AND SELL and CONVEY with GENERAL
WARRANTY OF TITLE and, subject to the matters hereinafter set forth, witl
ENGLISH COVENANTS OF TITLE unto the said Edward L. Sutherland and
Cordelia G. Sutherland, husband and wife, as tenants by the entirety with
full rights of survivorship as at common law, and not as tenants in common,
all that certain tract or parcel of land, with the appurtenances thereto,
situated in Albemarle County, Virginia, fronting on the west side of State
Route 635, containing 33.64 acres, more or less, being shown and described
as Parcel B-3 on a plat made by Frank A. Gregg dated October, 1974,
attached hereto and recorded herewith as part of this deed, and beinga
portion of the property conveyed to Edward L. Smith and H. V. Herold, Jr.
by deed of Joe H. Gieck, et al, dated December 20. 1972 and recorded in the
Clerk's Office of the Circuit Court of Albemarle County, Virginia in D. B.

521, P. 61, the interest of H. V. Herold, Jr. having been conveyed to
Edward L. Smith by deed dated August 9, 1973 and recorded in the Clerk's
Office aforesaid in D. H. 534, p. 578.
The property hereby conveyed is subject, insofar as it may be i
affected thereby, to easements granted to Virginia Electric and Power
Company by deeds dated July 20, 1937 and June 16, 1967 and recorded in the '
Clerk's Office aforesaid in D. B. 236, p. 588 and D. H. 432, p. 95, respec-
tively;
and to an easement granted to Virginia Telephone and Telegraph
Company by deed dated November 25, 1970 and recorded in the Clerk's
Office aforesaid in D. H. 481, p. 493.
