DESCRIPTION OF REQUEST: We request a variance of current
easement and/or set-back codes to allow: 1 ) enclosure
of an existing sideporch_. 2 ) building a deck on the rear

JUSTIFICATION SHALL BE BASED ON THESE THREE (3) CRITERIA:
1) That the strict application of this ordinance would produce
undue hardship.
Our house was built prior to current ordinances that severely restrict
even relatively minor modifications of existing floorplans . This
restriction is due to proximity of the house to the road in front
of the house. Current codes prevent us from making improvements
without moving the entire house back. This is not feasible because
of the small size of the parcel, location of the septic field behind
the house, and location of the workshop in the rear of the property.
2) That such hardship is not shared generally by other properties
in the same zoning district. and the same vicinity.
Unlike ours , other lnames in tnis area are generally —located on
larger parcels of land and conform to current ordinances governing
boundary set-back distances . Because of the proximity of our home
to the fromt boundary line, current codes prevent us from making
improvements-- even those that do not require addition of a new
structure positioned closer to the boundary. (Our request is to
enclose a porch, "stack" a second bathroom, and add a deck. )
3) That the authorization of such variance will not be of
substantial detriment to adjacent property and that the
character of the district will not be changed by the granting
of the variance.
. The proposed improvements will not detrimentally affect adjacent
properties in terms of either encroachment or visual integrity.
None of the three proposals result in new structures being placed
closer to the front or side boundaries of the property. Rather
than being detrimental, preserving and improving the property will
serve to maintain the unique character of this district.
The application may be deferred by the staff or the Board of
Zoning Appeals, if sufficient information necessary to this review
has not be submitted by the deadline.

Dear members of the board,
We request a variance to allow us to make three improvements on our
property.
1. Enclosure of an existing sideporch on the east side of property. We wish to
enclose this porch without altering its size. The porch is currently the
primary entrance to the house and will remain so. The exterior will be
finished using materials consistent the rest of house. The porch is on the
northeast corner of the house and is immediately adjacent to a living area on
the back of the house and the only bathroom for the house, which is on the
east side of the house. This bathroom is positioned between the porch and Free
Union Road.
2. Construction of a deck on the backside of the house. We would like to build a
deck on the rear of the house. This relatively simple structure would not be
visible from the front of the house and would not contain any enclosures.
3. Construction of a second bathroom. We wish to add a second bathroom to the
house. Our house currently has a single bathroom located on the first floor.
There are two upstairs bedrooms with no bathroom. We would like to add a
second bathroom by building directly above the existing bathroom. This would
not extent the existing outer boundaries of the house. The exterior finish of
the bathroom would be done in a manner consistent with the rest of the house.
In summary, we would like to make improvements to our home that do not alter
its current front or side boundaries. The deck would extend from the back of
the house. Thank you for your consideration of this request.
