LOCATION: West side of Rt. 604 approximately 0.5 miles north of its
intersection with Rt. 664
TECHNICAL REQUEST AND EXPLANATION: The applicant requests relief from
Section 10.4, Area and Bulk Regulations, which requires a front setback of 75 feet and
side setbacks of 25 feet. Variances of 10 feet from the front yard and 13 feet from the
rear yard are requested to allow the addition of a family room and basement to the rear
of the existing dwelling, 65 feet from the front property line and 12 feet from the rear
property line. Since the addition is sited within both front and rear setbacks, both must
be approved to allow construction.
RELEVANT HISTORY: None
PROPERTY DESCRIPTION AND QUALIFYING CONDITIONS: This property was
acquired in good faith by the Shiffletts in December 1992. The parcel is the same size
and shape now that it was in 1980 when the County Zoning Ordinance was adopted,
having been reduced for road dedication by county-approved subdivision plat in 1967.
At only one-half acre, this is a small, non-conforming parcel. Due to the exceptional
shallowness and the triangular shape of the parcel, the strict application of the setbacks
in our ordinance would effectively prohibit the use of this parcel. The 1967 survey shows
that the deepest point of the property is the southern end where it is only 105.27 feet
deep. With the 75 foot front and two 25 foot side yards, there is no building site on this
parcel at all. The existing dwelling was located on the parcel under a previous zoning
interpretation using the 30-foot setback that is shown on the recorded plat. The desired
addition will be near the center and on the rear of the structure. Because this involves
both front and rear setback variances, it would not be eligible for administrative approval
under the proposed revision of Section 6.4.
The property to the rear of this parcel is a five acre parcel that is already developed with
two dwellings, utilizing all of its development potential. Both dwellings are accessed
from and face north so that the rear yard of one is adjacent to the Shifflett's western
side yard. The area of the adjoining parcel behind the Shifflett's house is wooded.

APPLICANT'S JUSTIFICATION AND STAFF COMMENT: A review of the variance
criteria provided by the applicant and comments by staff follows:
Hardship
The applicant comments that the variance is necessary due to the following:
• They are a family of six who have outgrown their home;
• To improve the family, they need to expand the 1700sf of living space.
Staff concurs that imposing the zoning setbacks creates an undue hardship due to
shallowness and triangular shape of the parcel . However, with the existing dwelling,
reasonable residential use already exists.
1. The applicant has not provided evidence that the strict application of the
ordinance would produce undue hardship.
Uniqueness of Hardship
The applicant notes:
• Rural areas properties are usually larger and have more building space
It is staff opinion that the restrictions to building on this property due to its shape and
size are unique and not commonly recurring.
2. The applicant has provided evidence that such hardship is not shared
generally by other properties in the same zoning district and the same
vicinity.
Impact on Character of the Area
The applicant offers:
• The neighbors are very supportive of the improvements;
• The land is there and the living space is needed.
Staff agrees that the addition of the family room with a basement in the rear of the
dwelling will not change the character of the district.
3. The applicant has provided evidence that the authorization of such
variance will not be of substantial detriment to adjacent property and that
the character of the district will not be changed by the granting of the
variance.
STAFF RECOMMENDATION: Since only two of the three criteria have been met,
staff cannot recommend approval. However, should the Board find cause to approve
this request, staff recommends the following condition:
The variance is for the addition described in Building Permit 99-604AR only. Any
future additions would require additional variance approval.
