Subject: CFW Variances
You have asked for information regarding the wireless siting policy of the Board of
Supervisors and Planning Commission. As you are aware the County is currently in the
process of adopting a Wireless Telecommunications Policy. While this policy has not
yet been adopted I can provide you with some information which is based on the actions
for approval and denial of applications for wireless facilities.
The approach of CFW has been generally endorsed by the County. The approach used
by CFW has been to use wooden poles that allow the antenna to extend just above the
treeline (7 to 10 feet). This approach does require more facilities than would be
required by the use of conventional towers. In several requests (including those
currently under review by the BZA) a waiver has been required to allow the facility to be
closer to the property line (or right-of-way) than the height of the structure. Even if the
BZA grants a variance the Planning Commission will have to consider the waiver
request. This will allow the Commission to determine if the facilities are in keeping with
the County's efforts at facility siting.
As a status update on the requests under review you should be aware that the Planning
Commission has recommended approval of the special use permits. However, the
Commission has not acted on the setback waiver request. The Commission felt it was
appropriate to wait for BZA action before taking action on the waiver request.
