Request is to reduce the side setback from 25 ft to 10 ft to allow a house to be constructed.\qlr\ 41/ DESCRIPTION OF REQUEST: JUSTIFICATION SHALL BE BASED ON THESE THREE (3) CRITERIA: 1) That the strict application of this ordinance would produce undue hardship. 2) That such hardship is not shared generally by other properties in the same zoning district and the same vicinity. 3) That the authorization of such variance will not be of substantial detriment to adjacent property and that the character of the district will not be changed by the granting of the variance. . The application may be deferred by the staff or the Board of Zoning Appeals, if sufficient information necessary to this review has not be submitted by the deadline. 1 I hereby certify that the information provided on this application and accompanying information is accurate, true and correct to the best of my knowledge and belief. 0 t) - i - Signature Date Receipt# Date • Description of request: Potential purchasers of lot sixteen in Marshall Manor subdivision, Bryant and Karen Bibb request a variance in the twenty five foot minimum setback from the side property line. The Bibb's have had a preliminary survey of the property made (Tom Lincoln 974-1417) and soil evaluation/septic system study conducted by Baseline consultants (832-2409). Considering the topography of the lot and the only feasible location for the septic system as defined by Baseline consultants, the available space and location for the dwelling is less than twenty five feet from the south east property line. The Bibbs request a variance of fifteen feet (to build ten feet from the property line)on the south east property line in order to build on the lot. The property adjoining the property line where the variance is requested is not suitable for building. The Property lines, septic lines and proposed building have been marked with surveyors ribbon. 1. Our original desire was to build a one story house. In order to meet the covenant restrictions of the sub division which requires the houses to be two thousand square feet finished above ground, the dimensions of the house would have been roughly fifty five by forty. After discovering the above stated limitations, we revised our plans to a two story Cape Cod design which is only forty five feet in width. The lot has critical slope on both sides of the proposed building site that prevent the building site from being the required twenty five feet from the southeast property line. If no variance can be obtained the lot will not be suitable for building for the Bibb's. 2. This lot is one of only four remaining in the subdivision which was developed in the nineteen seventies. Being one of the smallest and one of the few lots in the subdivision that is located on a mountain ridge the building site is limited. (most probably why it has never been developed) due to the location of the septic and restrictions due to critical slope this lot is unique in it's demand for a specific and limited building location. 3. The proposed dwelling is very much in line with the rest of the subdivision. The lot adjacent to the proposed property line is undeveloped and also has restricted building sites due to critical slope. The area of the adjoining lot where the variance is requested is unsuitable for building but could be used as an entrance to the property.
