HomeMy WebLinkAboutVA199900015 Review Comments 1999-07-13 - 1 - STAFF PERSON: Amelia McCulley PUBLIC HEARING: July 13, 1999 STAFF REPORT VA-99-15 OWNER/APPLICANTS: Mike and Lorri Steele TAX/MAP/PARCEL: 8/33C ZONING: RA, Rural Areas ACREAGE: 2.094 acres LOCATION: on the west side of Rt. 664 (Markwood Rd.) approximately 600 ft. south of the intersection with Rt. 810 at Nortonsville. TECHNICAL REQUEST AND EXPLANATION: The applicants request relief from Section 10.4 of the Zoning Ordinance to reduce the front setback from 75 to 47 feet to allow an addition to an existing house. They are proposing to construct an addition to an existing single-family dwelling which is presently setback 25.3 feet from the right-of- way. The proposed one-story addition includes two bedrooms, bathroom, living room, dining area and breezeway. RELEVANT HISTORY: The need for the variance was determined when the applicants applied for Building Permit 99-1016 AR to do this work. PROPERTY DESCRIPTION AND QUALIFYING CONDITIONS: While this lot is not particularly small, it is pie shaped. The house is located where the property is shallow from front to rear, towards the point of the lot. The entire depth is less than 110 feet. The required setbacks alone (front 75 and rear 35) total 110 feet. Therefore, no addition or new structure which is detached could be built and meet the setbacks in that area. The addition is proposed on the side of the house where the lot widens. It cannot easily be setback further due to the location of a frame shed in the rear property directly behind it. The existing house is relatively small; it is 824 square feet. In summary, staff can find some unique conditions about the property and the house which warrant review under the variance criteria. APPLICANT'S JUSTIFICATION AND STAFF COMMENT: A review of the variance criteria provided by the applicants and comments by staff follow: Hardship VA 99-15 2 July 13, 199 Board of Zoning Appeals Amelia McCulley The applicant comments that the variance is necessary: • It is a hardship that my kids will be sharing 1 room for the next ten years without an addition. • I wouldn't have bought the home if I didn't think I could add on. • There is no way I can move my home so we could add on. • I can't afford a new home to move into. Staff can understand and support the applicant's comments. Having a house of this small size creates an undue hardship which favors granting the variance. 1. The applicant has provided evidence that the strict application of the ordinance would produce undue hardship. Uniqueness of Hardship The applicant comments that the variance in necessary: • The shape of the property is unique in a triangular shape. • The house was built in the 1940s way before setback. Staff finds these unique circumstances: • The lot is odd-shaped • The house predates zoning regulations • There is not sufficient lot width to construct an addition that would meet front and rear setbacks. • The house is relatively small and additional living space is justifiable 2. Evidence has been provided that such hardship is not shared generally by other properties in the same zoning district and the same vicinity. The applicant has provided evidence that the authorization of such variance will not be of substantial detriment to adjacent property and that the character of the district will not be changed by the granting of the variance. STAFF RECOMMENDATION: Since this variance request meets all three criteria, staff recommends approval for cause. Should the Board grant the variance, staff recommends the following condition of approval: This variance is for the addition proposed in this file only (Building Permit 99-1016 AR).
