STAFF REPORT VA-99-29 The Barry Building
OWNER/APPLICANTS: Woodbrook Associates, LLC.
TAX/MAP/PARCEL: 45 / 109C
ZONING: C1 , Commercial
ACREAGE: 0.9203 acres
LOCATION: in Woodbrook Crossing north of Rio Road, at the
northwestern corner of the intersection of Berkmar Drive and
Woodbrook Drive.
TECHNICAL REQUEST AND EXPLANATION: The applicant requests a variance from
Section 4.15.12.5 to allow a wall sign to be installed 24 feet above grade, a variance of
4 feet. The Zoning Ordinance limits wall sign height in this zoning district to 20 feet.
The proposed sign will be located on a building under construction and will read "The
Barry Building."
The sign will be composed of 12 inch high individual reverse-channel aluminum letters.
The entire sign is about 17 feet long. The letters of the sign are neon-lighted and will be
similar in appearance to Barracks Road Shopping Center. The sign is planned for the
east side of the building, which faces Berkmar Drive.
RELEVANT HISTORY: This lot was created by a subdivision approved on April 29,
1998. Lots #1, 2 and 3 all share a common entrance and parking area from Woodbrook
Court. This property is being developed under an approved site plan.
PROPERTY DESCRIPTION AND QUALIFYING CONDITIONS: The property is
somewhat square in shape. The rectangular building fronts on Berkmar Drive with the
parking in the rear. The building is a 14,000 square foot two-story building.
STAFF ANALYSIS: Staff cannot find evidence of an undue hardship in this case. It
appears that a wall sign, although lower in height, could be located on the building.
Therefore, staff recommends denial of the variance.

In the past, we have had recurring cases of wall sign height variances. This is
something we have drafted as a revision to the ordinance. The proposed height
complies with the proposed revision; however, this has not been approved by the Board
of Supervisors. (*The sign ordinance is in the workprogram to be taken to public
discussion soon.)
APPLICANT'S JUSTIFICATION AND STAFF COMMENT: A review of the variance
criteria provided by the applicant and comments by staff follows:
Hardship
The applicant comments that the variance is necessary:
• We are able to mount this sign within the 20 foot height limit; however, by doing so
we cannot center it on the building because of the building design. From an
appearance standpoint, it needs to be mounted in the building's center.
Staff cannot find an undue hardship when the basis is the aesthetics of the building. It
is not clear to staff that there would be a notable difference in appearance. More
importantly, there are no functional or structural considerations that staff can cite.
1. The applicant has not provided evidence that the strict application of the
ordinance would produce undue hardship.
Uniqueness of Hardship
• Generally speaking, the buildings in this area that are single level, do not have this
problem.
• There are three 2-story buildings in this area. One has no building-mounted sign.
The other is mounted above the windows, off-center on the end of the building. The
third evidently has a variance.
Staff finds that this situation is not unique. There are multi-storied buildings in the
County and specifically, within this district.
2. Evidence has not been provided that such hardship is not shared generally
by other properties in the same zoning district and the same vicinity.

Impact on Character of the Area
The applicant offers:
• Within the immediate vicinity, the "Pet Food Discounters" building has 2 building-
mounted signs that appear from the street to be mounted approximately 16 to 18
feet above grade.
• Across Berkmar from our site, the "Adventure Land" (now "Family Fun Center") has
a sign that appears to be 24 to 26 feet high.
Staff opinion is that there is no clear detrimental impact on the character of the area if
the variance is granted. Given the size of the building, one could argue that it may be
more appropriate to have a higher sign.
3. The applicant has not provided evidence that the authorization of such
variance will not be of substantial detriment to adjacent property and that the
character of the district will not be changed by the granting of the variance.
STAFF RECOMMENDATION: Staff cannot find an undue hardship in this case nor a
unique set of circumstances. Therefore, staff recommends denial for cause.
Should the Board find cause for approval, staff recommends the following condition:
1. Approval of this variance is limited to a wall sign height of no greater than 24 feet.
