We hope to build an addition to our home which would be sixty-nine feet from the public road right-of-way, which is six feet closer than the required seventy-five foot setback from a public road. We request this variance for the following reasons: 1. Strict application of this setback ordinance would produce undue hardship on our growing family. Our existing home is less than 1,000 square feet and has only one bedroom and one bath. Due to the mountainous terrain encroaching on the south side of our home, it would be extremely difficult and financially prohibitive to build an addition on the south. Building to the east of the home would require relocation of the driveway and electric, water and drainage lines. Building to the north would require relocation of the septic system and would also bring us closer to the public road. Building to the west is the only logical placement of our addition for the above- listed reasons. Failure to receive the requested variance would unreasonably restrict our use of our property. Furthermore, we purchased our property six and three quarter years ago with the intention of adding on to the home, not realizing that our plans would not meet the setback requirement. Our yard and the level of the home compared to the roadway to the road are drastically different, with the roadway sitting approximately twelve to fifteen feet below the yard. Visually, this marked difference in levels gave us no reason to suspect that meeting the setback requirement would be an issue. 2. There are no other homes on Shiffletts Mill Road(Rt. 687) of similar square footage that are as close to the road as ours, with the exception of one mobile home that is a rental property. 3. The authorization of this variance request would not be detrimental to adjacent properties or to the character of the neighborhood. In fact, the authorization of this request and subsequent completion of our proposed addition would only enhance the neighborhood and its character. We have contacted our adjoining neighbors 1 regarding our plans and none have reservations or objections. In fact, we have attached a letter from Mr. Walter Rails, whose property borders ours on the west and on the south, who supports our plans and our request for a variance. In addition, our plans call for the addition to be consistent with the existing style of the home and will complement the topography. 4. Lastly, we have received an opinion from the Assistant Resident Engineer of the local office of the Virginia Department of Transportation, Mr. H. W. Mills, that it is unlikely that Shi$Ietts Mill Road (Rt. 687)will be widened or paved in the near future due to the low traffic count of thirty vehicles per day. It is the opinion of Mr. Mills that our proposed addition would not interfere with such widening or paving. Umstadter who is asking for any comments we have about the widening or paving of Route 687, from Route 601 to Route 810. We cannot say that this road would never be widened or paved, but it is unlikely for some time with an average annual daily traffic of 30 vehicles per day, counted last in 1997. It would be our opinion that any future road improvements should not impact the home located above the road except for minimum widening of road that would be necessary which would cause the slope of embankment to be a little farther into yard. Our property is located approximately one mile from Free Unibn Road(Rt. 601) and approximately one and one half mile from Blackwell's Hollow Road (Rt. 810') As we discussed, my husband and I are hoping to build an addition to our home,which does not meet the county setback requirement from Shitetts Mill Road (Rt. 687). Due to the topography of our property and the road, we feel it is unlikely j that our addition would intrude on any future road widening or paving. Our home is approximately 12-15 feet above the road level and the corner of the proposed addition would be 69 feet away from the state right-of-way at the same level as the existing home. I would appreciate any statement you might be able to make to the Board of Zoning Appeals regarding the likelihood that Shiffletts Mill Rottd(Rt. 687)might ever be paved or widened and if our proposed addition might impede any such future road improvements. I suggest that you visit the site in order to better understand the topography anal our conviction that our proposed addition would be unlikely to impede future road improvements.
