STAFF REPORT VA-00-10
OWNER/APPLICANTS: David and Ruth Sullivan (owners) / Bukrim Home Center

ZONING: RA, Rural Areas
ACREAGE: 2.02 acres
LOCATION: On the east side of Route 719 approximately '/2 mile south of
the intersection with Route 712 near Alberene (5335
Alberene Road)
TECHNICAL REQUEST AND EXPLANATION: The applicant requests a variance from
Section 10.4 Area and Bulk Regulations, minimum front yard (existing public roads): 75
feet. This is a request to allow an existing manufactured home to remain as built, 62
feet from Rt. 719, a variance of 13 feet.
As a result of a physical survey for the title company, it was discovered that the home
does not meet the front setback. The representative from Bukrim Homes explained that
they measured the distance to the edge of the road instead of the front property line /
right-of-way line. The home is 76 feet from the road.
RELEVANT HISTORY: Building permit 99-1807 SF was issued on October 12, 1999.
A certificate of occupancy has not been approved.
PROPERTY DESCRIPTION AND QUALIFYING CONDITIONS: When a property
owner can show that his property was acquired in good faith and where, by reason of
the exceptional narrowness, shallowness, size or shape of a specific piece of property
... or where, by reason or exceptional topographic conditions or ... condition of such
piece of property, or of the use or development of property immediately adjacent
thereto, the strict application of the terms of this ordinance would effectively prohibit or
unreasonably restrict the use of the property ... provided that all variances shall be in
harmony with the intended spirit and purpose of this ordinance.
The grade of the property drops slightly from the road frontage to the rear of the parcel.
There is a stream in the rear with a required 100 foot septic setback. There are
overhead utility lines running along the northern side property line. The approved

subdivision plat creating this parcel requires a shared driveway with the parcel (vacant)
to the south. What appears to be a drainage swale is visible along a portion of the
southern side property line. The lot is rectangular in shape and meets the minimum 2
acre lot size for the Rural Areas district.
STAFF ANALYSIS: There are several constraints for building a home on this property;
however, it is possible to build without a variance for setback. It is unfortunate that
neither staff nor the applicant discovered the setback problem when it would have been
easier to relocate the home so as to comply. While it would involve a cost and
inconvenience to relocate the home at this point, this variance does not satisfy all three
criteria. Therefore, staff recommends denial for cause.
APPLICANT'S JUSTIFICATION AND STAFF COMMENT: A review of the variance
criteria provided by the applicant and comments by staff follows:
Hardship
The applicant comments that the variance is necessary:
• Due to the stream at the rear of the property we had to put the home further up
towards the road to keep the septic from draining to the stream. We also wanted to
avoid the steep drop off which would place the home higher than would be feasible.
Staff concurs that the stream and the slope somewhat limit the location of a gravity
septic field. However, it is possible to locate the home so as to meet the front setback.
The fact that the home is presently installed would involve additional expense and effort
to relocate it to meet setbacks. However, this is not an undue hardship "approaching
confiscation"as mentioned in the variance criteria.
1. The applicant has not provided evidence that the strict application of the
ordinance would produce undue hardship.
Uniqueness of Hardship
The applicant comments that the variance is necessary:
• No other properties have the same property that we're aware of.
Staff finds that there are some specific constraints to construction on this property such
as the stream, the joint driveway easement and the topography. However, these are

not severe constraints unique to this property and it is possible to locate this home so as
to meet setbacks.
2. Evidence has not been provided that such hardship is not shared generally
by other properties in the same zoning district and the same vicinity.
Impact on Character of the Area
The applicant offers:
• This home I think will actually improve the character of the road. It's one of the
newest homes around. It is done very nicely and has the appearance of site-built. It
has block perimeter skirting.
Staff is of the opinion that the proposal does not appear to negatively impact the
adjacent property or the character of the area. The closest house is across the state
road and diagonal from this property. Most people would not necessarily know that this
country road has a full width right-of-way. It is not located much closer than homes on a
prescriptive right-of-way.
3. The applicant has provided evidence that the authorization of such
variance will not be of substantial detriment to adjacent property and that the
character of the district will not be changed by the granting of the variance.
STAFF RECOMMENDATION: Since the application only satisfies one of the three
criteria, staff recommends denial.
Should the Board chose to approve the variance, staff recommends the following
condition:
This variance is limited to the home constructed in building permit 99-1807 SF. Any
additions shall either comply with the ordinance or will require an amendment of the
variance.
