STAFF REPORT VA-00-14
OWNER/APPLICANT: David and Carolyn Holmes, owners;

LOCATION: 16 Deer Path Road, Bellaire Estates subdivision, west side
of the Rt. 250 Bypass, approximately 0.5 miles south of the
intersection of Rts. 29/250 Bypass and Rt. 250 Business
TECHNICAL REQUEST AND EXPLANATION: The applicant requests relief from
Section 4.10.3.1, Height Limitations - Exceptions, which states:
The height limitations of this chapter shall not apply to barns, silos. . . .radio or
television antenna or tower,. . . . and, provided further that such structure shall not
exceed one hundred (100) feet in height in a residential district.
A variance of 15 feet is requested to allow a 115-foot self-supporting wood pole
structure for a wireless telecommunications facility in a residential district. The applicant
would like to construct a wireless facility consisting of a wooden monopole with flush
mounted antenna, an equipment cabinet, and some accessory equipment within a 10' x
15' lease area.
[In addition to the underlying zoning district setbacks, Section 4.10.3.1 requires that a
tower be setback a distance equal to its height. Although the Board of Zoning appeals
can reduce the minimum primary structure setbacks required under Section 10.4, the
additional setback required based on the height of the tower under Section 4.10.3.1
must be reviewed and acted upon by the Planning Commission. Should the PC fail to
approve that reduction, the applicant could then choose to request a variance from that
section. It will be reviewed as part of the special permit application. This is not before
the BZA presently.]
RELEVANT HISTORY: VA 92-35 was approved to allow an addition to the dwelling.
SP-97-67 was approved to allow the existing tower on the property. There is a pending
special use permit to allow another tower on the property if this variance is approved.

PROPERTY DESCRIPTION AND QUALIFYING CONDITIONS: There are no
particular features of this parcel that qualify it for a variance under the State Code
guidelines. The property conforms to the district regulations in all aspects and already
has reasonable use with one existing dwelling and one existing tower for wireless
communication.

It is questionable if this tower meets the Personal Wireless Service Facilities Policy that
is currently pending. The parcel is not at a particularly high elevation as compared to its
surrounding area, and does not have any more of a "sight line" than other properties in
the general area. The proposed tower may be somewhat out of sight, but could be
viewed as a horizontal co-location which is discouraged.
STAFF COMMENT: The height limitation of Section 4.10 imposed on the residential
zoning districts is apparently an arbitrary one. Since the height limitation for dwellings in
the RA, VR, R-1 , R-2, R-4 and R-6 districts is 35 feet, this 100 feet is not some spatial
proportion, such as three times the structure height or 105 feet. Staff can not find nor
think of any reason that 100 feet was chosen as the limit. Although the Ordinance does
not currently allow the Commission to vary the height limitations, this regulation would
be a logical addition to the pending Personal Wireless Service Facilities Policy that
recommends the Commission be permitted to set the yard requirements for towers.
APPLICANT'S JUSTIFICATION AND STAFF COMMENT: A review of the variance
criteria provided by the applicant and comments by staff follows:
Hardship
The applicant comments that the variance is necessary because:
• Without a variance, the use of this property for a facility of sufficient height to extend
above the top of the trees is eliminated.
• The antennas must extend above the tree line in order for the signal to be effective.
• The trees in the immediate area have been surveyed to be 105 feet.
The issue here is whether to grant a variance on the height of the tower, not where or if
it could be located on the ground. This property suffers no hardship. It already has
more than reasonable use with the residence and one tower for wireless
communications. Staff cannot identify any hardship as described under the Code of
Virginia relating to granting a variance.
1. The applicant has not provided evidence that the strict application of the
ordinance would produce undue hardship.
Uniqueness of Hardship
The applicant argues that:
• The proposed site is level with the roadway, but slopes downhill away from the
property line to the east.
• Other properties in this zoning district do not contain an existing tower.
• Other properties in this zoning district do not contain existing access easements that
enable the construction of the new facility with such a minimal level of tree clearing.

Staff finds that since there is no hardship under the State Code criteria, there is nothing
to be unique. Although this property may have unique attributes for a tower site, there
is nothing unique as related to hardship.
2. The applicant has not provided evidence that such hardship is not shared
generally by other properties in the same zoning district and the same
vicinity.
Impact on Character of the Area
The applicant offers:
• There are no structures that would be impacted by the variance.
• The applicants own the vacant property to the north.
• The tower will not exceed the height of the trees by more than 10 feet. Therefore, it
will not be easily visible and the character of the area will remain the same.
Staff does not agree that the additional height will not impact the character of the area.
Since this is a residential area and structure heights are generally lower, this tower will
be out of character if not well screened by trees. The older and thus taller the trees, the
more likely that they may die either from natural causes or disasters. Since there has
never been a condition that states a tower must be reduced if the tallest tree is toppled,
there is a chance of exposure and degradation to the neighborhood. That is the
situation with the existing tower on this site. A storm uprooted the tallest tree near the
tower thus exposing it to passers-by on the Rt. 29/250 Bypass.
3. The applicant has not provided evidence that the authorization of such
variance will not be of substantial detriment to adjacent property and that
the character of the district will not be changed by the granting of the
variance.
STAFF RECOMMENDATION: Since none of the criteria have been met, staff
recommends denial. Should the Board find cause to approve the request, staff
recommends the following condition:
The location and height of the trees within 25 feet of the tower site shall be
surveyed and noted in this file prior to issuance of the building permit for the tower.
Should any trees on the survey be removed for any reason-including but not limited to
wind, rain, hail, tornado, hurricane-the tower shall be shortened to be no more than 10
feet taller than the closest tree.
