HomeMy WebLinkAboutVA200000025 Review Comments 2000-09-05 STAFF PERSON: John Shepherd PUBLIC HEARING: September 5, 2000 STAFF REPORT VA-00-25 OWNER/APPLICANTS: Gage Land Company, LLC (owner) / Hightech Signs (applicant) TAX/MAP/PARCEL: 78/15 ZONING: HC Highway Commercial & EC Entrance Corridor ACREAGE: 1.754 acres LOCATION: South side of Route 250 East, Richmond Road approximately 2/10 of a mile east of the intersection with Route 20 North. TECHNICAL REQUEST AND EXPLANATION: The applicant requests a variance from Section 4.15.12.6 to allow a wall sign to be installed 23 feet above grade, a variance of 3 feet. The zoning ordinance limits wall sign height in this district to 20 feet. The proposed sign is an internally illuminated oval cabinet measuring 96 inches by 56 inches. The sign will be located on the tallest of the three sections of the Pegasus Motorcar Company building RELEVANT HISTORY: The Pegasus site plan was signed on August 19, 1999. PROPERTY DESCRIPTION AND QUALIFYING CONDITIONS: Qualifying conditions for hardship can be met when a property owner can show that his property was acquired in good faith and where, by reason of the exceptional narrowness, shallowness, size or shape of a specific piece of property ... or where, by reason or exceptional topographic conditions or ... condition of such piece of property, or of the use or development of property immediately adjacent thereto, the strict application of the terms of this ordinance would effectively prohibit or unreasonably restrict the use of the property ... provided that all variances shall be in harmony with the intended spirit and purpose of this ordinance. This property is not of an unusual shape, extraordinarily small or steep or the like, as mentioned in the preceding characteristics creating hardship. The ordinance wall sign height restriction has created a hardship which has led to recurring variance requests. A revised sign ordinance has been drafted that provides for a maximum wall sign height of 30 feet in the HC district. The Architectural Review Board has issued a Certificate of Appropriateness for this site. The proposed sign, while not identical to that shown to the ARB, has been determined by the Design Planner to be in general accord with the approved design. The Design Planner is of the opinion that the design of the building lends itself to the sign placement as proposed. VA 00-25 2 September 5, 2000 STAFF ANALYSIS: While the sign would not produce a detrimental impact on the character of the area, there is no evidence of an undue hardship based on the unique characteristics of the subject property. The difficulty results from the requirements of the ordinance itself. In this circumstance, we are obligated to revise the ordinance. Therefore, staff recommends denial of the variance. APPLICANT'S JUSTIFICATION AND STAFF COMMENT: A review of the variance criteria provided by the applicant and comments by staff follows: Hardship The applicant comments that the variance is necessary: The sign will not fit on the fascia of the building at 20 feet or lower. Staff opinion is that the hardship is based on the language of the ordinance. We concur that the proposed sign location is logical based on the design of the building. Other options which would meet the ordinance are not as aesthetically appropriate. 1. The applicant has not provided evidence that the strict application of the ordinance would produce undue hardship. Uniqueness of Hardship The applicant comments that the variance in necessary: The design of the building does not allow the sign to be under 20'. Margaret Pickart agrees that it will look better with this building for the top of the sign to be at 23 feet. Staff confirms that Margaret Pickart, the Design Planner, has found that the design of the building lends itself towards the sign placement as proposed. Staff finds that the hardship is shared generally. 2. Evidence has not been provided that such hardship is not shared generally by other properties in the same zoning district and the same vicinity. Staff is of the opinion that the proposal will not detrimentally impact the adjacent property or the character of the district. 3. The applicant has provided evidence that the authorization of such variance will not be of substantial detriment to adjacent property and that the character of the district will not be changed by the granting of the variance. STAFF RECOMMENDATION: Since the application satisfies only one of three criteria, staff recommends denial for cause. Should the Board chose to approve it, staff recommends the following condition: This variance is for one sign.
