Located at 775 Tanglewood Road in the Flordon subdivision. TM 59A/Parcel
1-C-15, zoned Rural Areas. Requests reduction of rear yard setback from 25 to
11 ft. to allow replacement of a porch with a sunroom.

1) That the strict application of this ordinance would produce
undue hardship.

Description of Request:
The house and porch were built by Sue Grove in 1983. We bought the house(with the
porch)in 1987 from the original owners, David and Janice Shea. The house was built
toward the rear of the lot due to the topography of the property. A creek and drainage
easement are located toward the front of the property. (This drainage easement required
a"bridged"driveway to be built in order to access the house.) Beyond this"valley"there
is a rise in the topography requiring that the house be built even further back on the lot.
(Two sets of front steps totally 19 had to be built into the bank that backs up to the front
door of the house.) On August 31, 2000 the rear property line was resurveyed by Arthur
F. Edwards, C.L.S. The right rear corner of the house measured 26.09 feet from the rear
property line. The right rear corner of the porch measured 15.71 feet from the rear
property line. We respectfully request that we be allowed to replace the existing
screened-in porch with a sunroom. Our builder, Jeff Easter, strongly recommends that
we replace the porch, which measures 12 feet deep by 21 feet wide, with a sunroom that
is slightly larger, measuring 16 feet deep by 22 feet wide. This sunroom would require a
variance of 11 feet from the rear property line. We have discussed this proposal with our
neighbors, Judge Paul and Judith Peatross, whose property backs up to our property in the
rear, and they have no objections. They will be sending a letter in support of our variance
request.
We simply want to improve an existing structure(the porch)by replacing it with a
slightly larger sunroom. As an oil painter, I need studio space that will provide me with
the proper lighting in order to do my work. There is no other location for the sunroom to
be built as there are drainage fields located to the right side of the house and the steep
grading and driveway to the left side of the house would not permit an addition there.
According to Mr. John Grady,the original set-back to our property was 20 feet and later
was changed to 35 feet.
Justifications:
1. As already explained, we bought the house with the porch in 1987. The house and
porch were built in 1983 by Sue Grove. Apparently the original set-back was 20 feet
and was later changed to 35 feet. If we had to remove this non-conforming structure
it would produce a real hardship.
2. As already explained,the topography of our lot forced the builder to build the house
towards the rear of the property. Or neighbors generally do not share the same
topography hardship on their properties.
3. As already explained, we have discussed our proposal with the only neighbors(Judge
Paul and Judith Peatross)whose property backs up to the rear of our property. We
have thoroughly explained our proposal to them, and they have no objections to our
replacing the existing porch with a slightly larger sunroom. They will send a letter in
support of our variance request. This proposed sunroom would mostly be blocked
from the Peatross' view by a bank behind it with a row of tall pine trees. In the front
this sunroom would be completely hidden behind our house and would not be visible
by the neighborhood.
