Rural Areas. Requests a reduction in the side setback from 25 to 7 ft to allow the
removal and reconstruction of a nonconforming wing.

JUSTIFICATION SHALL BE BASED ON THESE THREE (3) CRITERIA:
1) That the strict application of this ordinance would produce
undue hardship.
2) That such hardship is not shared generally by other properties
in the same zoning district and the same vicinity.

Enclosed is a Variance Application, recorded Plat, large-scale drawing of the site condition, and our
check for the filing fee.
Our request is based on an existing non-conforming situation at the Hardie Residence. At the present
time, a wing of the house that was built in the early-1970s is 7.48 feet from the property line. When built, we
are assuming the side yard setback was 10 feet. At the present time,the side yard setback at Farmington for this
property is 25 feet.
I spoke with Jan Sprinkle and asked about how this affects any remodeling that we plan to do to this wing
and any new construction. We are proposing an extension to this wing; however, all new work will be wholly
outside of the 25 foot side yard setback. Jan reviewed the code and concluded that we could remove the roof
system and exterior wall finishes, but that the footing, foundation, floor framing system, and exterior wall
"studs" that extend beyond the 25 foot side yard setback must remain in place.
The purpose of our request at this time is to allow the Contractor to remove only the wood stud walls
of the exterior to facilitate the new siding and construction. We may find once the roof,and interior and exterior
finishes have been removed(which is allowable)that these exterior stud walls might not be in conformance with
today's building code and that they may have to be rebuilt to allow the new windows and roof system.
Rather than discover this during construction and have to wait six weeks for review and approval, we
felt that it was prudent to request this modification at the present time.
