the Clerk's Office of the Circuit Court of Albemarle County in D 11. 239 p . 8,
and DeeI No. 2 dated March 10, 1941, recorded in said f:lerk's Of, i e in D. B . 250 p .

and between SAX E T PRISES, L.L.C., a Virginia limited liability
company, hereinafter referred to as "Grantor", and MICHAEL M.
HERRING and MARTHA ANNE HERRING, husband and wife, and IDRIE B.
HERRING, hereinafter referred to as "Grantees".
IDEAS, by Deed dated October 26, 1971, and recorded in the
Clerk's Office of Albemarle County, Virginia, in Deed Book 496, i

page 516, Michael W. Herring, Martha Anne Herring, also known as x
Martha A. Herring, Roy W. Herring and Marie B. Herring were granted
a right-of-way more particularly described therein; and
IDEAS, Roy W. Herring is now deceased and Marie B. Herring,
Michael U. Herring and Martha A. Herring, along with the Grantor,
desire to continue to have an easement from their properties to
U.S. koute 250, however, the parties have agreed to change the
location of that easement as reflected in this agreement.

($10.00), and other good and veluable consideration, Grantor hereby
GRANTS and CONVEYS unto Michael W. Herring and Martha A. Herring
and Marie B. Herring an easement of ingress and egress Prim
properties described on Albemarle County Tax Map 56 as Parcels 96A
and 96B across the• 0.67 acre open space parcel designated a.i eccesn

16 in a ieixutherly direction to U.S. Route 250.
o! At such tine as Little fox Lane and Cory Farm Road become part
of the Virginia Department of Transportation highway system, then
this personal easement along Little Fox Lane and Cory Fars Road
will be extinguished and Michael M. Herring, Martha A. Herring and
Marie B. Herring shall have the right to use those roads as any
member of the public would have a right to use those roads,
however, the right-of-way over the 0.67 acre open space will remain
and run with the land. At such time as the final subdivision plat
of Cory Farm is approved and recorded, the easement over the 0.67
open space will be shown on said plat. ,
Until such time as Little Fox Lane and Cory Farm Road are
passable for ordinary traffic, the easement granted Grantees in
Deed Book 496, page 516, will remain in effect, however, upon the
ability of said roads to accept ordinary traffic, that easement
will l`'e extinguished without further written instrument.
