You are hereby notified that, after an investigation of the above-described property, the Deputy
Zoning Administrator has determined that the following constitutes a violation of the Albemarle County
Zoning Ordinance:
1. The construction of the detached garage (BP# 2000-1734NNR) was begun prior to
the issuance of a building permit. No building permit has been issued for this structure.
Section 31.2.1 Permits Required; Conformance
Buildings or structures shall be started, reconstructed, enlarged or altered only after a
building permit has been obtained from the zoning administrator. No building permit
or certificate of occupancy shall be issued in violation of zoning or other local
ordinances.
2. The detached garage is located approximately 42 feet from the right of way of Route
664 to the northwest corner of the building and approximately 45 feet from the right of way
of Route 664 to the southwest corner of the building. This location does not meet rural area
yard (setback) requirements.
Section 10.4 Area and Bulk Regulations
Yards, minimum:
Front (existing public roads) 75 feet
Front (internal public or private road) 25 feet
Side 25 feet
Rear 35 feet
Section 36.1: "Any building erected contrary to any of the provisions of this ordinance or
contrary to any condition imposed upon any conditional rezoning, issuance of a special use permit or
approval of a site plan, and any use of any building or land which is conducted, operated or maintained
contrary to any of the provisions of this ordinance or any condition imposed upon any conditional
rezoning, issuance of a special use permit or approval of a site plan, shall be a violation of this

ordinance and the same is hereby declared to be unlawful. The zoning administrator may initiate
injunction,mandamus, abatement, criminal warrant or any other appropriate action to prevent, enjoin,
abate or remove such erection or use in violation of any provision of this ordinance."
A Stop Work Order has been in effect since September 13, 2000 (see attachment 1). Also the
Zoning Administrator, Amelia G. McCulley,has informed you that your variance application is
incomplete (see attachment 2).
If you intend to submit the necessary information to complete your variance application you are
hereby ordered to do so by May 7, 2001. Your failure to comply with this order may result in legal
action being taken against you.
If you intend to remove this structure and void building permit 2000-1734NNR you are hereby
ordered to notify me in writing by May 7, 2001. Your failure to comply with this order may result in
legal action being taken against you.
If you are aggrieved by this determination, you have a right to appeal it within thirty (30) days of
the date notice of this determination is given, in accordance with Section 15.2-2311 of the Code of
Virginia. If you do not file a timely appeal, this determination shall be final and unappealable. An
appeal shall be taken only by filing with the Zoning Administrator and the Board of Zoning Appeals a
notice of appeal which specifies the grounds for the appeal. An appeal application must be completed
and filed along with the fee of$95. The date notice of this determination was given is specified on
page 1.

Dear Mr. Harris:
On this date, a Stop Work Order has been posted at the referenced job site. This Stop Work
Order is placed in accordance with Section 117.0 of the 1996 Virginia Uniform Statewide
Building Code.
It has been observed that a garage-like structure is being constructed without a building permit.
It is a violation of Section 107.0 of the 1996 Virginia Uniform Statewide Building Code to begin
construction of a building prior to the issuance of the appropriate permit(s).
No construction is to proceed on this building until this situation is corrected.
It is necessary that this office be contacted immediately so that a permit application can be made,
and the permit review process can begin. Upon satisfactory issuance of the appropriate building
permit(s), the Stop Work Orders will be removed from this project.

Dear Mr. & Mrs. Harris•
We are unable to process your variance application for the December 5m Board of Zoning Appeals
meeting. The application does not provide information which is necessary to meet the legal
advertising requirements. Once you submit the information requested, we will schedule your
application. If you submit the necessary information by December 4`h, your application will be
heard on January 2, 2001
Please clarify if the proposed garage will be attached to the existing house or if it will be
freestanding. The setbacks are 6 feet side and rear and 75 feet from the edge of Route 664
easement or right-of-way. The 6 foot setback could be increased if there are conflicts with existing
easements If the garage will be attached to the house, the setbacks are 25 feet side, 35 feet
rear, and 75 feet from the edge of Route 664 easement or right-of-way.
In order for your application to be complete, please submit the following
1. A written statement as to whether the garage will be attached or detached
2. Setback distance and statement as to which yard setback will not be met. For example, the
proposed garage will be setback 40 feet from the front.
3. Complete the 3 criteria on the application form to address the setback variance request. (Copy
attached)
If this garage will in any way expand the already existing violation on the property, the variance and
building permit may be delayed. You are advised to resolve the existing garage violation as soon
as possible.
