Thu Wig- pe-t"c,h a k,yuM (5p oo-(21). • Description of Request: Triton PCS, Inc requests a variance from Section 10.4, Area and Bulk Regulations, Rural Areas District, which requires a front setback of 75 feet on a thoroughfare state road. A variance of 20 feet, 7 inches is requested to allow construction of a wireless telecommunications facility consisting of a steel monopole, an equipment cabinet and an icebridge, each as shown in more detail in the attached set of plans The 94-foot monopole is proposed to be 54 feet, 5 inches from State Route 708 (Dry Bridge Road), while the other structures will be slightly farther back but still within a 30-foot by 30-foot lease area. Triton PCS, Inc. has submitted a special use permit application (SP 00-64)for a 94-foot steel pole telecommunications facility (painted brown) to be located on tax map parcel 73-31D, property owned by David C. Weber. Justification Criteria: 1. That the strict application of this ordinance would produce undue hardship. The strict application of the ordinance in this instance would produce undue hardship on the applicant and on the property because it would hinder the applicant's efforts to comply with Albemarle County's recently adopted personal wireless facilities policy, which requires that wireless telecommunications facilities be screened from view of surrounding properties and roadways. The Albemarle County wireless telecommunications policy requires that wireless telecommunications facilities be as minimally visible as possible, and be located within a grove of mature trees, at a height just over the top of the tallest tree within 25-feet of the facility. This proposed facility is sited within a grove of trees on the subject property, which siting is intended to minimize the visibility of the structures from neighboring properties, Interstate 64, and from State Route 708 In order for the facility to be located 75 feet from the State Route 708 right-of-way, it would have to be moved an additional 20 feet, 7 inches to the east However, there are no trees in that location that would effectively screen the facility as required by the telecommunications policy. The Board of Supervisors is unlikely to grant a special use permit for a wireless facility located in the middle of a field, as it would likely be extremely visible By contrast, however, at the proposed location, the proposed wireless facility will be sited within a grove of mature trees, which, given the design and color of the facility (all materials will be painted a flat, dark brown color to blend in with the existing wooded area) will result in only minimal visibility from surrounding properties and roadways. It is important to note that the County's wireless telecommunications policy recommends that the zoning ordinance be amended to allow the Planning Commission to establish setbacks to locate wireless telecommunications facilities. Once the ordinance is so amended this type of request would not require any action by the Board of Zoning Appeals. However, at this time there has been no action to amend the zoning ordinance to carry out the intent of the policy. As a result, the applicant faces a hardship in that it is required to comply with the policy that dictates that only minimal levels of visibility are acceptable, but does not have the benefit of being able to look to the Planning Commission for relief from the setback requirements, as is expressly intended by the policy. Thus, a variance from Section 10.4 as requested will carry out the spirit and intent of the County's policy and enable the applicant to comply with the policy as it is required in order to obtain a necessary special use permit. For all of these reasons, the strict application of the ordinance would produce undue hardship on the applicant and on the property. 2. That such hardship is not shared generally by other properties in the same zoning district in the same vicinity. This hardship is not shared generally by other properties in the same zoning district in the same vicinity, as this property has the unique attribute of having characteristics that make it uniquely suited for a wireless telecommunications facility under the requirements and limitations of the County's policy for such facilities, but these characteristics happen to be located less than 75 feet from the right-of-way line The unique topography and location of the property makes it uniquely suited for a facility of the kind the County's policy requires -- one that is located within a grove of mature trees, away from residences, that will not require any tree clearing or removal, and that will be only minimally visible from surrounding properties and roadways. However, at the same time, the location of these tall trees so close to the right-of-way unnecessarily limits the use of the property in a manner not shared by other properties. Other properties have trees that are situated farther back from the right-of-way, that would enable the siting of a wireless facility in a manner that would be in compliance with the County's policy as well as the current zoning ordinance. Therefore, the hardship that this property suffers from is not shared generally by other properties, and can only be remedied by the granting of the requested variance from the setback requirements of the ordinance 3. That the authorization of such variance will not be of substantial detriment to adjacent property and that the character of the district will not be changed by the granting of the variance. The granting of the requested variance will not be of substantial detriment to adjacent property, nor will the character of the district be changed by the granting of the variance. In fact, the granting of the variance will actually allow a facility that will be minimally visible from surrounding properties, which will limit or eliminate any 2 substantial detriment to such properties. Locating a highly visible facility on this property may have a substantial detriment on the adjacent property But granting the variance will enable the applicant to site the facility in the location on the property that is most appropriately suited for such a facility -- within the grove of mature trees that will effectively screen the majority of the facility from surrounding properties and roadways. By siting the facility in the proposed location it will be nearly invisible from Interstate 64 and only minimally visible from State Route 708. In contrast, siting the facility 75 feet or more from the right-of-way in the middle of an open field in order to meet the strict requirements of the ordinance will result in what is likely to be an extremely visible facility, which could be a substantial detriment to adjacent property. In addition, such high levels of visibility could negatively impact the character of the district. Therefore, granting the variance would allow the applicant to meet the criteria of the County's wireless telecommunications policy and to build the facility in the most appropriate area, enabling it to blend in with the other trees on the property and thus with the character of the area, without having a substantial impact on adjacent properties. This is consistent with the overriding goal of the County's policy -- to require wireless telecommunications facilities to be designed, located and sited in a manner that enables them to blend in with the trees so as to prevent a detrimental impact on the character of the area where they are sited.
