L.011' DESCRIPTION OF REQUEST: JUSTIFICATION SHALL BE BASED ON THESE THREE (3) CRITERIA: 1) That the strict application of this ordinance would produce undue hardship. 5.'A 2) That such hardship is not shared generally by other properties in the same zoning district and the same vicinity. 3) That the authorization of such variance will not be of substantial detriment to adjacent property and that the character of the district will not be changed by the granting of the variance. Description of Request: To grant a variance of 105 sq. feet to allow the HerringBone's Mural to remain on side of building. JUSTIFICATION SHALL BE BASED ON THESE THREE (3) CRITERIA: 1. That the strict application of this ordinance would produce undue hardship: This property has been used as a convenience store for over some 25 years as well as a restaurant before that time. The store predates the 1969 Albemarle County Zoning Ordinance. The Mural on the east side of the building is the only form of a sign I have displaying the name of my business. Not to allow this Mural to remain on the side of the building would not only cause a financial burden it would not allow me to display the business name. It was costly to have the Mural painted and it will be costly to alter the same. The size of the Mural is in question, stating that it causes a distraction. The purpose of any sign is to call attention to that particular business. What purpose is a sign to any establishment if it cannot be seen? The Mural was placed on the side of the building due to the fact the front of the building is primarily all glass. The side of the building facing the west has a huge exhaust fan located on it, leaving the only available space on the east end of the building. Please note that even though the Mural is larger than allowed it is located on the side of the business and does not directly face Route 250 West. It actually faces towards Brownsville Road. This is an in and outlet road for several residences. When traveling down Route 250 West the Mural is to the side of the highway. I strongly believe that smaller signs cause a more serious problem than one that can be easily seen by travelers. Example: A person or persons looking for a Hotel such as the Doubletree on Route 29. It stands to reason if the sign can be seen by the driver well in advance it certainly allows the traveler to have ample time to make a driving decision. I also realize that Albemarle County is concerned with appearance and beauty of the area and I agree signs should be done in good taste but they are definitely needed. I am of the opinion and other people in the community agree that the Mural on the side of my business is done in good taste and is actually a very pretty piece of art work. 2. That such hardship is not shared generally by other properties in the same zoning district and the same vicinity: It has been suggested that because of the size of the sign it creates a distraction. The store parking area is also located on that side of the building, which does not always allow for the full view of the Mural to be seen. Please find enclosed photos of other businesses along the Rockfish Gap Turnpike and other areas in Albemarle County, which I feel might cause a distraction and are not as appealing to the eye as the Mural displayed on my building. Please take note that two of the photos were taken on Route 29 North. The traffic on Route 29 North is far greater than on Route 250 West. This creates a very dangerous driving situation, not to mention how unsightly they appear. 3. That the authorization of such variance will not be of substantial detriment of adjacent property and the character will not be changed by the granting of the variance: Due to the location of my business the granting of the variance will not affect any adjacent property and will not be detrimental to the character of the district. As stated above the Mural has been done in good taste and is a beautiful piece of art. I feel it adds to the character of the community.
