ATTACHMENT 1 VARIANCE APPLICATION PROJECT NAME: 2260 IVY ROAD ( STILLFRIED LANE) TAX MAP 60 PARCEL 36 A LOT B DESCRIPTION OF REQUEST: The singular objective of this Variance Application is to permit a shared parking area between two existing buildings on adjacent sites. I have recently purchased a small lot adjacent to my home and architectural office on Stillfried Lane, across the street from the University of Virginia's Kluge Rehabilitation Center. This newly acquired property includes a quadruplex that shares a common gravel parking area with my home. The quadruplex was built in the 1960's. At the closest point, the rear corner of the existing building is approximately five feet from the angled property line. The property has been a neglected and poorly maintained rental property for more than thirty years. My intention is to improve the appearance and character of both properties and visually tie the parcels together with a cohesive landscaping, planting and parking design. I do not intend to change the current residential use of the quadruplex. The existing parking arrangement is random, unsightly, threatens the wellbeing of the existing trees. The unkept appearance, unrestrained parking arrangement, and lack of thoughtful landscaping diminish the character and quality of the neighborhood. I would like to reorganize the existing parking into a more efficient, convenient and cohesive element between the two buildings. On the advice of County Planning Staff I am seeking to rezone 2260 Stillfried Lane from R-1 to C-O. to permit the shared parking. Such a rezoning would necessitate approval/acceptance of the existing five foot building setback from the 50 feet required by the Ordinance when a C-O District is adjacent to a Residential District. It is important to note that the use of the existing building will remain residential. Therefore, request is made to approve the existing building set-back of five feet. This request recognizes the existing site conditions and the mixed-use nature of the surrounding properties. JUSTIFICATION Criterion 1: The strict application of this ordinance would produce undue hardship. It would be an undue hardship to physically move the existing building in order to comply with the commercial setback requirement. This is especially relevant given the commercial nature of the non-conforming adjacent property which has functioned as a commercial office for decades, and has not yet been rezoned to commercial status. Commercial use of these properties is consistent with, and supports the Comprehensive Plan. Criterion 2: The hardship is not shared generally by other properties in the same zoning district and the same vicinity. This hardship is not shared generally by other properties in the same zoning district and same vicinity. For example, the nonconforming commercial use on the adjacent property does not appear to comply with setback, buffer, and sewer requirements of the Ordinance, nor does the neighboring Teague Funeral Home, the Kluge Children's Rehabilitation Center and the West End Shops. All of these properties are likely to be in noncompliance with the strict application of Zoning Ordinance. When and if the Owner were to rezone the adjacent property to C-O, to match its current use, then this variance would no longer apply. Also, because the adjacent use is in fact commercial, provision of a large buffer intended to separate commercial from residential would appear be unnecessary in this case, and to miss the spirit and intent of the Ordinance. Criterion 3: The authorization of such variance would not be of substantial detriment to adjacent property and that the character of the district will not be changed by granting the variance. The authorization of a variance would cause no detriment to adjacent properties. The proposed parking layout permitted by this variance would serve to provide an organized, convenient, and efficient parking area for the adjoining parcels which are presently loosely connected by a free-form gravel drive and haphazard parking arrangement. The current parking arrangement threatens the survival of some existing trees and the parking area itself is transformed into a huge mud wallow following a heavy rain. Granting this Variance will have a positive affect on adjacent properties. The most immediate affect will be fewer vehicles parked on the street. The proposed parking area design, landscaping and associated building renovation will serve to improve the quality, character, and add lasting value to the entire neighborhood. Granting this Special Use request for a small on site parking area will have a positive affect on adjacent properties. The most immediate affect will be fewer vehicles parked on the street. A notable and commendable feature of the proposed parking arrangement, and consistent with guiding principles 6, 7, &8 of the Neighborhood Model, is that it is essentially internal to the site. The parking is relegated to a convenient position between existing buildings, thoughtfully planted, in the center of the properties as opposed to the conventional parking layout in front of buildings and thus removing the building edge from the street. The proposed parking arrangement and associated landscaping will benefit adjacent properties by removing off site parking, obscuring on site parking by providing a cohesive landscape on these two adjacent sites. I believe this project may ultimately be useful as a model on how parking can be successfully integrated into existing sites to the benefit of pedestrians and the entire community 4. How will the proposed Special Use affect the character of the district surrounding the property? I think this question was also addressed in my answer to the previous question. By moving vehicles off the street into and organized, well designed, and thoughtfully landscaped parking area the quality and appearance of the entire district will benefit. 5. How is the use in harmony with the purpose and intent of the Zoning Ordinance? A. This Special Use clearly improves orderly development and use of the property, consistent with the purpose of the Ordinance. B. This Special Use would allow safe, convenient use of the land that is harmonious with the landscaped character of the surrounding land. • C. This Special Use is consistent with the goals of the Comprehensive Plan and with at least six of the twelve guiding principles of the Neighborhood Model. D. This Special Use will be designed, constructed and maintained with personal funds and will not become an undue burden to the community. In fact this Special Use will put money back into the community immediately via construction spending, and over time will contribute back to the community through increased land value and property taxes. 6.What additional regulations provided in Section 5.0 of the Zoning Ordinance apply to this use? Describe your request in detail: The singular objective of this rezoning request is to permit a shared parking area between two existing buildings on adjacent sites. I have recently purchased a small lot adjacent to my home and architectural office on Stillfried Lane, across the street from the University of Virginia's Kluge Rehabilitation Center. This newly acquired property includes a quadruplex that shares a common gravel parking area with my home. The quadruplex has been a neglected and poorly maintained rental property for more than thirty years. My intention is to improve the appearance and character of both properties and visually tie the parcels together with a cohesive landscaping, planting and parking design. I do not intend to change the current residential use of the quadruplex. The existing parking arrangement is random, unsightly, threatens the wellbeing of the existing trees, and diminishes the character and quality of the neighborhood. I would like to reorganize the existing parking into a more efficient, convenient and cohesive element between the two buildings through careful and appropriate planning and planting.
