STAFF REPORT VA-2001-020
OWNER/APPLICANT: Samuel and Katherine Garrison Life Estate / Lori Garrison
(applicant)
TAX MAP/PARCEL: 14-29D
ZONING: RA, Rural Areas
ACREAGE: 2.721 acres
LOCATION: On the west side of Route 810, approximately 1 .5 mile north
of the intersection with Route 668 at Mount Fair.
TECHNICAL REQUEST AND EXPLANATION: The applicant requests relief from
Section 10.4 Area and Bulk Regulations, in order to subdivide 2.721 acres with two
homes into two lots of 2.0 and 0.72 acres. Variances necessary to create the 0.72 acre
lot are as follows:
a) to reduce the minimum lot size from 2.0 to 0.72 acres, a variance of 1 .28 acres; and
b) to reduce the road frontage on an existing public road (Route 810) from 250 to 95
feet, a variance of 155 feet.
This property is owned by Lucy and Lori Garrison (sisters), with a life estate for their
parents, Samuel and Katherine Garrison. Samuel and Katherine Garrison live in a
house built around 1956 which is located on the front portion of the property. An older
mobile home is located on this property behind the Garrison parents' house. The
proposed subdivision of the property will result in a 0.7 acre lot including the Garrison
parents' house. Lori Garrison, the variance applicant, intends to remove the existing
older mobile home on the property and build a new house. She is planning to build the
new house on the hill behind her parents' house, on the proposed 2.0 acre lot. In order
to obtain financing for the new house that does not also encumber the property with the
parents' house, they are proposing this subdivision.
RELEVANT HISTORY: In 1975, the County signed a plat combining a 2 acre portion of
adjoining property (improved with a mobile home), with a then-nonconforming 0.72 acre
lot, creating the current 2.72 acre parcel. The 0.72 acre lot predated the zoning
regulations and was improved with the Garrison parents' home. While the proposed
subdivision has not been surveyed and drafted, the Garrisons are proposing to
subdivide generally along property lines which will restore the 0.72 acres as a separate
lot and have the 2.0 acres stand alone as a separate lot.

For a period of only a few months, 2 acres was added to this 2.7 acre property and was
then removed. (A plat signed by the County on 10-10-97 added 2 acres from parcel
29A. A plat signed by the County on 1-16-98 removed the 2 acres and restored the
2.72 acre lot.)
PROPERTY DESCRIPTION AND QUALIFYING CONDITIONS: The 0.72 acre
proposed lot is rectangular in shape and is about 95 feet wide and 295 feet long. It is
currently improved with the Garrison parents' home, a circular driveway, a well in the
rear and septic field in the front and an accessory building. Because of the size of the
property (the proposed 0.72 acre lot) and the location of the existing improvements,
including the well, staff is concerned that a reserve septic field cannot be
accommodated on this property. In that case, it appears that an amendment to this
variance will be necessary. Staff recommends deferral until these issues are resolved.
In this case, the applicant has expressed an interest in having the Board determine if a
variance would be supported, prior to investing time and money in having the property
surveyed and/or soils work completed. If a septic reserve cannot be found within the
proposed 0.72 acre lot, the lot will not meet the zoning ordinance requirements for a
building site. Either: a) they must seek a variance of this ordinance requirement to
provide less of a septic reserve or no reserve at all; or b) they must redesign the
subdivision so as to include more area with suitable soils for septic reserve, in the lot
containing the Garrison parents' home. This second option would also require a
variance because both proposed parcels would be less than the minimum 2.0 acre lot
size, instead of one proposed parcel under 2.0 acres in the current subdivision design.
With the exception of the 3 month period, this property has remained the same since
1975. At the time of adoption of the Albemarle County Zoning Ordinance, the 0.72 acre
lot existed separately and the 2 acres was part of an adjoining parcel. Because the
2.72 acres with 2 dwellings does not comply with the 2.0 acre per dwelling density
requirement, it is subject to the nonconforming regulations. Under these nonconforming
regulations, a nonconforming mobile home may be replaced with another mobile home.
This provision was intended to provide affordable housing and to promote the
replacement of older mobile homes which do not meet current Building Code standards.
However, there is no provision which allows the replacement of a nonconforming mobile
home with a modular or stick-built home.
Therefore, because the applicant does not wish to replace the mobile home with a
mobile home, she must either comply with the zoning ordinance or must obtain a
variance. She could seek a variance for the replacement home without subdividing the
property. Again, she chooses to subdivide to avoid placing a mortgage on the entire
property. Staff cannot support this variance request and is concerned that it is
essentially a rezoning by decreasing the density requirements of this zoning district.
Staff suggests that the Board consider the following options:
1. Deny the variance request; or

2. Defer the variance request for the following reasons: review to determine if or where
septic reserve exists for the Garrison parents' house; and review to consider a
subdivision redesign which would result in a larger lot. Redesign would decrease
the size of the lot for the proposed new home and would increase the lot which
includes the Garrison parents' home — resulting in variances for both lots because
neither would total 2.0 acres; or
3. Approve a variance which allows the replacement of the mobile home with a new
home as desired, but does not allow subdivision of the property.
APPLICANT'S JUSTIFICATION AND STAFF COMMENT: A review of the variance
criteria provided by the applicant and comments by staff follows. Staff comments are
written in italics and follow the applicant's comments
Hardship
The applicant notes that the variance is necessary:
• The adherence to this ordinance will prevent the owner from being successful at
purchasing a replacement of the trailer with a modular home.
Staff does not find it to be an undue hardship that under the ordinance, the mobile home
may only be replaced with another mobile home. This mobile home provision is a
special exemption with a specific intent, as previously stated.
Staff does not agree that denial of this variance request effectively prevents the
applicant from replacing the mobile home with another home. The mobile home may be
replaced with another home, whether or not it is a mobile home — with a variance,
without subdividing the property. It is the subdivision of the property that necessitates
the variance as proposed. Because the applicants do not wish to obtain a mortgage on
the entire property, they are choosing to subdivide. While staff understands the desire
not to place a mortgage on the Garrison parents'portion of the property, the parents do
hold a life estate and should continue to enjoy the same rights to the property under a
mortgage held by the applicant, their daughter. It is staff's position that while
subdivision may be desirable, subdivision is not necessary to allow the applicant to build
her house.
The 2.7 acres with 2 houses is nonconforming in terms of density in this zoning district
by lacking a total of 4 acres or 2 acres per house. Planning principles anticipate that
over time, uses will eventually comply and be consistent with the zoning regulations.
The proposed 0.7 acre lot is basically equivalent to R-2, Residential zoning which allows
2 dwellings per acre or a 0.5 acre lot size. While the 2 houses on 2.7 acres does not
meet current density requirements, both houses are supported by this acreage. Staff is

concerned that once the 0.7 acre lot is divided off separately, issues such as septic
reserve may not be as easily resolved if there are different owners. *Please note that
100 % septic reserve for this lot has not yet been confirmed. If it is not possible within
the 0.7 acres, an amendment of this variance will be necessary to include a reduction of
septic reserve.
Staff is primarily concerned about the variance to reduce lot size. In staff's opinion, this
does not constitute an undue hardship approaching confiscation.
1. The applicant has not provided evidence that the strict application of the
ordinance would produce undue hardship.
Uniqueness of Hardship
The applicant notes:
• The original parcel was conveyed in 1955 with the second parcel conveyed to the
owner in 1975. At that time a compliant parcel to the 1960's zoning ordinances was
created. However there was a trailer on the property which has remained.
Staff notes that it is relatively common for nonconforming lots to be combined with
additional land so as to become conforming. There are numerous cases in which
subdivisions were platted with multiple, small and impractical lots. Several lots are often
combined to create one more practical building lot. This combination of property and
abandonment of the smaller lots is advisable and should be promoted in some cases.
There are cases throughout the County where nonconforming lots which are built with
homes, are limited in terms of replacement of the homes.
Since staff finds no hardship, staff is unable to find that the hardship is unique.
2. The applicant has not provided evidence that such hardship is not shared
generally by other properties in the same zoning district and the same vicinity.
Impact on Character of the Area
The applicant offers:
• The authorization would be of benefit not only to the family but to the community.

Staff offers pros and cons in terms of the character of the area.
Cons: The proposed lot size is almost 1/3 of the required lot size in this zoning district.
Zoning district lot sizes are based in part on practical considerations, such as
accommodating water and sewer, access, etc. In addition, the lot size of the zoning
district creates the character of the area. It is staff's opinion that a lot size as proposed
is not appropriate for the character of the area. Based on this 0.72 acre lot size, this
property should be zoned R-2, Residential. This zoning is resented for Development
Areas and property served by public utilities.
Pros: The proposed lot is relatively consistent with the size of others in the immediate
vicinity.
3. The applicant has not provided evidence that the authorization of such
variance will not be of substantial detriment to adjacent property and that the
character of the district will not be changed by the granting of the variance.
STAFF RECOMMENDATION: Since none of the three criteria for approval have
been met, staff recommends denial of this request. Staff is of the opinion that if the
replacement home should be permitted, it is more advisable to allow it on the existing lot
without subdivision. If the Board is so inclined, staff recommends deferral in order to
allow the septic reserve to be determined and to consider redesign which increases the
lot containing the Garrison parents' house.
Should the Board find cause to approve it, staff recommends the following condition:
1 . Approval of this variance does not include a reduction in septic reserve area.
Should a 100% septic reserve not be available, this variance must be amended.
