Hardship Justification Statement
The first complete set of plans with engineering was dated
10/23/85 . These were submitted shortly thereafter for County
approval by the Planning, Commission. However , Greg Hiemenz
(Stereotypes) , owner of the adjoining property to the north,
submitted request for site plan approval at the same time .
The County decided to look at both requests as if it was one
developing site . All of the plans and engineering were re-
turned. The second set of plans and engineering were approved
after several alterations . These included all setbacks , ease-
ments , building setbacks , building footprints , common area
parking for Lots A, B and C. 411

Lot A was developed by Ron Martin without alteration. Lot B
has been developed by Salem Eways , Inc . with major alterations
as to footprint and parking loss . It is somewhat baffling to
see how original requirements and design were not followed;
and, even more difficult to understand because the same engineer
drew both, our original as wellas for Eways .
We respectfully request approval of our hardship in order to
get under roof before winter weather.

DESCRIPTION OF REQUEST: Request is made for variance in parking
requirements for development of Lot C . Woodbrook North. The site
was designed with shared parking for all site owners . However,
this has been altered for the benefit of Lot B (Eways ) . thus making
it necessary to request a parking variance for Lot C .
JUSTIFICATION SHALL BE BASED ON THESE THREE (3) CRITERIA:
1) That the strict application of this ordinance would produce
undue hardship.
Due to whatever reasons , the planned parking and easements for the
total development of Woodbrook North has been altered with the
completion of Lot B. This ahs created a tremendous hardship for
development of Lot C due to parking requirements affecting the
feasibility of development .
2) That such hardship is not shared generally by other properties
in the same zoning district and the same vicinity.
Other properties in the same complex do not have this hardship
as supported by letters submitted by each.
3) That the authorization of such variance will not be of
substantial detriment to adjacent property and that the
character of the district will not be changed by the granting
of the variance.
The approval of a parking variance will in no way harm adjacent
businesses of Woodbrook North, or change the character of the
district . In fact, the business owners are very much encouraging 41111
the development of Lot C. THe entire area will benefit from the
building' s appearance and landscaping planned. I also refer to
letters from Eways and Martin attached.
The application may be deferred by the staff or the Board of
Zoning Appeals, if sufficient information necessary to this review
has not be submitted by the deadline.

In reply to your request for information, I would estimate that
most of the time we use about 1/2 of the parking spaces on our
property for customer parking.
During peak times , Saturdays , we may use a few more spaces for
customers, but usually only have 4 or 5 employees cars here .

Subject: Parking at Ron Martin Appliance, 1885 Seminole Trail
Dear Mr. Smith,
This letter is in answer to your question concerning the sufficiency
of parking spaces at our Charlottesville store location.
There is almost never a time when even half of our 52 spaces are
occupied. Days go buy when the parking spaces next to Woodbrook Dr.
and next to US 29N are not used at all.
We have more than doubled our business since we built the store in
1987 and had no parking problems at all, nor do I ever envision us having
a problem.
Our only concern is the divider that was added behind our store
when the Eways store was built. Most customers don't understand it's
intended purpose and therefore don't use it. Several people have hit it and
caused damage to their cars. This is a particular problem in winter when
snow hides it. How would you like to hit a curb at 10-15 miles/hr?
