JUSTIFICATION SHALL BE BASED ON THESE THREE (3) CRITERIA:
1) That the strict application of this ordinance would produce
undue hardship.

in the same zoning district and the same vicinity.
3) That the authorization of such variance will not be of
substantial detriment to adjacent property and that the
character of the district will not be changed by the granting
of the variance.

has not be submitted by the deadline.

To Whom it May Concern:
Per the application for variance, we would like to request that a variance be
granted for the obvious and potentially damaging hardship of the KIDS "R" US
located in Charlottesville, Virginia. This particular KIDS "R" US is located in an
existing Toy's "R" US store which inhibits the KIDS "R" US' identity. TOYS "R"
US is strictly a toy store and people identify this business with their obvious
product. KIDS "R" US on the other hand,is primarily a children's clothing store
with their own logo, marketing scheme, as well as different over all concept.
The businesses within the vicinity of the KIDS "R" US location are not plagued
with the problem of trying to locate a totally different business entity within their
existing structure. These businesses already have their own sign identity, therefore
there is no shared hardship for said businesses.
This variance will not harm any existing businesses, for the area in question is in
a commercialized area. This also will not change the charcter of the district in any
detrimental way for it is only logo advertisment and identity for the potential
merchant.
