DESCRIPTION OF REQUEST: Please see attached statement
JUSTIFICATION SHALL BE BASED ON THESE THREE (3) CRITERIA:
1) That the strict application of this ordinance would produce
undue hardship.
The construction is in progress and to move the building to
comply with the S(_1' building seperation requirement would
produce undue hardship .
2) That such hardship is not shared generally by other properties
in the same zoning district and the same vicinity.
This is one of two properties in the subdivision that have this
zoning provision.
3) That the authorization of such variance will not be of
substantial detriment to adjacent property and that the
character of the district will not be changed by the granting
of the variance.
The authorization of this request will be of no detriment to
adjacent property nor will the character of the district be
changed by the granting of the variance . .
The application may be deferred by the staff or the Board of
Zoning Appeals, if sufficient information necessary to this review
has not be submitted by the deadline.

Purpose for a Request of Variance
To amend the approved permit of an attached 3 car garage with grandmas guest
apartment area upstairs to a detached 3 car garage with grandmas guest apartment
area upstairs.
Intent of Structure
The purpose of the structure is to provide additional garage space and an upstairs
living area for the occasional guest , primarily the grandmas.
The additional living space is to be used occasionally for guest purposes only. There
are no guest areas available in the house due to the large size of the family. This
space is intended primarily for both grandmas when they visit as they currently reside
out of state.
In the future when the extra area is not required for guest the intent is to use the space
as an office/study.
Why not attach
The building plan was first approved as an attached three car garage with an
apartment above. As the construction progressed it became apparent that a better
choice architecturally was not to attach the new structure to the main house with a
hallway as originally planned. The attached design took away from the character of
that outside area of the main house.
Consideration of other location on the property
To relocate the garage/apartment is not practical. Due to the location of the existing
septic system and reserve, existing property lines, the topography and other features
of the property, including streams and lake, another location for the structure is not
possible.
Other locations for the structure will obstruct views and otherwise distract from the
uniqueness of the property .
Considerations for the current location
The current location of the structure is the only location which works with the physical
characteristics of the property.
The current location is the only location which does not interfere with the views and
does not otherwise distract from the uniqueness of the overall property itself.
Services to the current location such as septic, water, power, phone, cable TV, eta are
provided from the main house.
The current location provides the allusion of attached from the main highway and
most other viewing angles
Other
To subdivide this property is impractical due to the location of the structures, property
lines, existing septic systems and reserves, topography and other physical
characteristics of the property such as streams and lake. In addition, there would be
no practical site to locate a separate septic system.
Attached or detached does not affect the character of the neighborhood.
To the adjacent neighbors the two structures appear to be attached.
Attachment to the title can be made not to allow for the division of the property.
The Ivy Farm Statement of Restrictions, Covenants and Conditions restricts the
subdivision of any lots by the owner.
The Ivy Farm subdivision plat includes a statement requiring any further subdivision
of the property must be approved by the Albemarle County Planning Commission.

Section 2 .03 . Conditions. No improvements, alterations, repairs,
3xcavations, changes in grade, major landscaping or other work which in
:ny way alters the exteriors of any property or the improvements located
.hereon from its natural or improved state existing on the date such
)roperty was first conveyed in fee by the Declarants to an Owner shall
De made or done unless and until the plans, specifications, working
3rawings, and proposals for the same showing the nature, kind, shape,
type, materials and location thereof shall have been submitted to and
approved in writing by the ACB, pursuant to Section 2 .04. No building,
fence, wall, residence, or other structure shall be commenced without
the prior written approval of the ACB.
Section 2 .04. Procedures. In the event the ACB fails to approve,
modify or disapprove in writing a request for approval required herein,
within sixty (60) days after plans, specifications, or other appropriate
materials have been submitted in writing to it, approval will be deemed
granted.
Section 2 .05. Presumption. In the event that the appropriate
equitable action together with a lis pendens has not been commenced
within one year after the completion of any activity requiring the
approval of the Architectural Control Board, it shall be conclusively
presumed that such activity is approved by the Architectural Control
Board.
ARTICLE III. GENERAL PROVISIONS
Section 3 .01. Restriction on Further Subdivision. No Lot shall
be further subdivided or separated into smaller lots by an Owner other
than the Declarants without the written consent of the Declarants, their
