Davis P 0 Box 7 Batesville, VA 22924 RE: Proposed access waiver and subdivision of Tax Map 71 Parcel 26B1 Dear Ms. Davis: After review of your request it was determined that the proposed 9+ acre division would be the first subdivision of Tax Map 71 Parcel 26B 1. This proposal would be the second division of land, but the first subdivision of the parent parcel. The first division of land was a rural division. The rural division, that was approved on 05/27/92, essentially separated itself from any access requirements per Section 14-505 of the Albemarle County Subdivision Ordinance. Section 14-505 does not apply to parcels created by rural divisions, as defined in Section 14-207, so a waiver for access to the proposed subdivision is not necessary. It should be understood that any future subdivision of the proposed 9+ acre parcel or the residue will be required to access the public road via the access created for the proposed 9+ acre parcel. A waiver of Section 14-505 would be necessary if any future subdivision would propose access from anywhere other than the access approved through the first subdivision.
