You have requested that the Virginia Electric and Power Company (Virginia
Power or Company) consent to an encroachment by MacMillan, Pace and
Bowen, Inc. on, over and/or under a part of its transmission right-of-way identified
as:
Charlottesville - Clifton Forge Corridor, Parcel # 34

The location of the encroachment is as follows:
Along the east side of Virginia Route 676 in the Samuel Miller Magisterial District
of Albemarle County, Virginia
The encroachment for which you have requested consent is described as:
Grading activities in a cut section for a subdivision access road
Virginia Power, under its easement(s) identified above, hereby consents to the
encroachment described above subject to the following terms.
1. The minimum distance required by OSHA shall be maintained between electrical
conductors and any part of the encroachments or equipment used in the installation
or maintenance of the encroachment. Sag of conductors varies with changes in
operating and ambient temperatures, therefore, required clearances will be based
upon maximum sag. See Exhibit "B".
2. Company access to its facilities shall not be hampered at any time by the installation,
use, maintenance or presence of the encroachment. Company shall not be liable for
damage to the encroachment resulting from exercise of its easement rights.
3. Requestor shall notify Company's Right-of-Way Management Representative at the
location shown below if any counterpoise [ground wire buried 18 to 24 inches deep]
is damaged, cut, or severed, so necessary repairs can be made by Company the
cost of which shall be reimbursed by the Requestor.

4. Requestor shall be responsible for all associated costs for the repairs of Company
facilities (including but not limited to structures, guys, anchors, counterpoise, or
landscaping) damaged by Requestor, his employees, contractors or agents I"'
5. If the encroachment is determined to be unsafe by the Company at a future date, the —
unsafe condition shall be corrected at the Requestor's expense within 30 days after —
written notification by the Company. If not so corrected by the Requestor, the unsafe
condition may be corrected by the Company at the Requestor's expense without
liability for any resulting damage.
6. This consent in no way reduces the Company's rights under the easement(s)
identified above. The Company may at any time exercise its easement rights in a 44
way that conflicts or interferes with the encroachment described above. rs.

7. Requestor shall give at least 5 days advance notice, except in emergencies, of any ss
construction activities being performed within right-of-way to Company's Right-of- i
Way Management Representative so that the Company may have an inspector cs
to
present while the work is in progress if deemed necessary, and Requestor pays the
costs of the inspector.
8. The encroachment grading as proposed on Exhibits "B" and "C" is approved with no
part of the encroachment or construction activities located within 25 feet of any
Company structure, foundation, guy, anchor or any other Company facilities. The
grading as proposed shall be a maximum 4 foot cut on the rise above the road.
9. The encroachment grading activities will not begin within the transmission easement
area until distribution pole XL77 and its down guy and anchor have been replaced by
Virginia Power Albemarle District personnel.
10. Permission for the encroachment described in Exhibits "B" and "C" does not include
permission for storage on the right-of-way of material or equipment related to the
encroachments.
11. No construction debris shall be buried on the right-of-way which shall include but not
be limited to stumps, large boulders, concrete, asphalt, trees, storm drainage pipe,
hazardous waste, scrap materials, or any other waste material.
12. No portion of any house, garage, porch, deck, shed, barn, playhouse, or any other
type of structure whatsoever shall be permitted on the right-of-way.
13. No temporary construction offices, sheds, or related structures are to be placed on
the right-of-way.
14. Trash receptacles and dumpsters shall not be placed on the right-of-way.
15. Should it be necessary to verify the final grade of the proposed cut/fill, then it will be
the responsibility of Requestor to reimburse Company for all actual costs. If the
verification reveals that the cut/fill/grading was not done as approved, then
Requestor is responsible for all costs involved with correcting the problem(s).

16. No burning of construction trash will be allowed on the right-of-way. --

17. Requestor shall restore any erosion or settling on the right-of-way related to the
installation or maintenance of the encroachment. Requestor shall comply with all
state and local erosion and sedimentation control laws, and shall not adversely affect
grade elevations and water drainage patterns.
18. Requestor or their heirs, successors, and assigns hereby agree to indemnify and
save harmless Company, its officers, agents and employees from any and all claims,
demands, damages, including death, and liability of every kind and nature
whatsoever for, on account of or growing out of the consent hereby granted, except
when such claims and demands are caused solely by the negligence of Company, its a�
agents, employees, successors or assigns.

Renovate an existing spillway on a small dam so that it can safely pass the 100-year storm event requirement. All work will be done
on the existing dam.
5. Findings
This is regarding your request to perform work in the waters of the United States,as described in part 4 above. This activity has
been reviewed and found to satisfy the criteria contained in the Corps Nationwide Permit(3),attached. (The Corps Nationwide
Permits were published in the Federal Register(61 FR 65874)on December 13, 1996 and the regulations governing their use can be
found in 33 CFR 330 published in Volume 56,Number 226 of the Federal Register dated November 22, 1991.)
Provided the enclosed conditions are met,an individual Department of the Army Permit will not be required. In addition,the
Virginia Department of Environmental Quality has waived 401 certification for Nationwide Permit Number 3.
Enclosed is a"compliance certification"form,which must be signed and returned within 30 days of completion of the project,
including any required mitigation(see nationwide permit condition number 14). Your signature on this form certifies that you have
completed the work in accordance with the nationwide permit terms and conditions.
This verification is valid for two years from the date of this letter,unless the Norfolk District Engineer uses discretionary
authority to modify,suspend or revoke this verification. The Chief of Engineers will periodically review the nationwide permits and
their conditions and will decide to either modify,reissue or revoke the permits. The existing nationwides are scheduled to expire on
February 11,2002. If the nationwide permit(s)verified in this letter are reissued without modification or if your activity complies
with any subsequent nationwide permit,the expiration date of this verification will not change. However, if the nationwide permit(s)
verified in the letter are modified or revoked so that the activity listed above would no longer be authorized and you have
commenced or are under contract to commence the work,you will have twelve months from the date of that permit change to
complete the activity. Activities completed under the authorization of a nationwide permit which was in effect at the time the
activity was completed continue to be authorized by that nationwide permit.
It is your responsibility to remain informed of changes to the nationwide permits. We will issue a special public notice
announcing any changes to the nationwide permits when they occur.

RE: Transmission Encroachment Agreement
Dear Mr. Dorman:
This is to request an Encroachment Agreement for a proposed subdivision located in the
Ivy Magisterial District of Albemarle County. The name of the subdivision is Merriwether
Lane and is located on the south side of Tilman Road (State Route 676) approximately
1.3 miles north of Route 250.
A private road shall be constructed for this subdivision as well as grading for a sight
distance easement. Construction of the private road shall be outside of the VPECO
Easement. The grading for the sight distance shall be along Tilman Road and cross
through the VEPCO Easement as shown on the attached drawing.
The property is Tax Map 58 Parcel 3J. The Owner is MacMillan, Pace and Bowen, Inc.,
1227 Mountain Road, Charlottesville, VA 22901 as recorded in DB 1909 PG 220. Alex
