I have received the 1'submittal of the HOA declaration and will put it in the review queue.
QUESTION: Is it correct that you only included the Subdivision Plat as a reference document and not as a rebsubmittal?
It appears to not have been revised since the previous review and it still shows the easements that will recorded in the
easement plat prior to the subdivision plat approval.
Therefore it must be updated for that change prior to the next resubmittal.

The ROE Agreement (corrected) between Foundations and Berkmar is required for RP approval. WPO201900050 Amendment
I (approval) is required for RP approval. Since site work occurs off -site, though I hadn't considered it, yes, a corrected ROE

It is probably good that Charles knows the extent of the issues that have come up since our meetings with the applicant
in December.
From your info below I understand that from an Engineering perspective some of the changes I listed are required to
the off -site agreement before WPO Amendment approval (which is a prerequisite for Road Plan approval).
Therefore, I think at this point Scott Collins needs to be given clear direction on the changes that need to be made to
the agreement.
Since this impacts the WPO (and subsequent Road Plan) approval unless you disagree I think it is appropriate for
engineering be the one who first reaches out with that info and then I will follow up later (soon) with my easement plat
review comments.
The site plan has been resubmitted as well, but is not at the front of my queue yet. The comments will be added to
that as well when it is time.
The only question in all of that is whether engineering is willing to specify all items shared below and not just the ones
engineering requires.
We can discuss what is appropriate and how that should move forward.

I'm really sorry if I gave the impression that Charles was meeting with Scott on Berkmar Overlook.
It is my understanding the meeting that Charles already had scheduled with Scott Collins, before I reached out to
Charles yesterday, was on a totally different subject.
The timing was just beneficial, so that Charles could broach the issues I had found with the agreement letter for the off -
site improvements.

Engineering recommends ROAD Plan, WPO Plan Amendment, Easement Plat, Final Site Plan, and Final Subdivision Plat
approval as soon as minimal plan approval requirements are met; to -date, they have not been. Going back 3 months, on
multiple occasions, Planning and Engineering have felt close to ROAD plan approval, but delay receiving off -site Right of
Entry (ROE) Letter/ Agreement to access and work on the adjacent child care parcel, change without notification to SWM
facility contours /calculations /drainage shown with the ROAD plan that depart from approved WPO design, and late -stage
coordination with RWSA, have caused plan approval delay. Please see recent email to Collins Engineering (CE): 3/20/2021
9:32 AM (ROAD Plan); 3/20/2021 12:06 PM. I have not received a response from CE, but rather, learned Scott Collins has
requested a meeting with you. Perhaps the county engineer could join that meeting as issues involve Engineering, ROAD plan,
and 3/17/21 county engineer Berkmar Overlook review. Engineering is positioned to approve WP0201900050 Amendment # I
and the ROAD Plan (SUB202000004) as soon as possible. CE throughout has pressed for approval. At times, I was inclined to
think we were there, and am grateful for Paty's careful consideration of global plat -site plan /subordinate plan (WPO-ROAD)
approval requirements; relationships between plans; effect of approval; effect on Foundations Child Development; and design
change contributing role (with plan inconsistencies) to multiple delays. Learning of your meeting with CE, I hope to bring you
up to speed on review status, and circumstance. Not mentioned, the sheer time devoted to multiple Berkmar Overlook plans,
often dropping other work to make CE email a priority, nearly all driven by plan inconsistencies /design change, for example: to
approved WPO without notice to Engineering. A WPO Plan Amendment is now required to resolve inconsistencies;
inconsistencies noted in county engineer review comments on subsequent townhouse WPO plan application. WPO Plan
Amendment is required prior to ROAD Plan approval. Please feel free to share this note with others.
Berkmar Overlook plans are a web made worse since design was changed without notice, plans are inconsistent, ROE letter is
incomplete, and certain Planning /Engineering requirements are not met. ROAD Plan bond is posted. The developer may incur
carrying costs. The developer may grade the site under approved WPO201900050, but may not construct roadbed, drainage,
pavement, walks, signs, etc. without an approved ROAD Plan, despite having posted a ROAD Plan bond. Paty is a detail -
oriented, responsive, vital member of staff. I try in every instance to approve plans that meet minimum requirements. Thanks,

Thanks for consistently accurate, thoughtful comments on the ROAD Plan, and Agreement Letter with Foundations Child
Development.
A few items:
• Provided ROE (letter) exists and is otherwise acceptable (corrected), this letter alone is sufficient from Engineering
perspective to allow entry and work on TMP 04500-00-00-112FO (Foundations Child Development).
• In other words: A corrected ROE letter would take the place of an off -site temporary construction easement on the
recently submitted easement plat (SUB2021-22) for Berkmar Overlook from Engineering perspective.
• Second item, below: Engineering defers to Planning. From Engineering perspective, we only need to ensure access
which allows work to be performed (access + grading).
• We have no reason to rely on a ROE Letter to stipulate specific or detailed improvements that will occur and are shown
with approved plans.
• If, for example, improvements on Foundations Child Development parcel are shown on the approved ROAD Plan, that
meets Engineering's needs.
• Planning Division needs, however, may fairly or essentially require additional items or details be included on the ROE
to avoid a LOR for Foundations.
• `... the attached exhibit should be part of the PDF that is submitted to the County for our documentation
purposes. Otherwise we can not see what they have agreed to." Perfectly stated; Engineering agrees.
• Third item: Not necessary for Engineering purposes (see first bullet, above). No need (our perspective) to revise plat
to show either temporary construction easement, or to include Foundations signature block.
• Engineering needs a revised Agreement with correct Exhibit (since Exhibit referenced) to approve the ROAD plan. If a
second Agreement later, to meet Planning Division needs, is required, that may be an option.
• This circumstance —an Agreement letter perhaps poorly reviewed by Engineering and consequently insufficient to meet
ROAD Plan approval needs, does affect ROAD Plan approval.
• The ROE letter, required, does not delay ROAD Plan approval as much as WP0201900050 Amendment 1 approval,
which is prerequisite to RP approval.
• As stated, we are inclined to approve the ROAD Plan once minimal plan approval requirements are met —our position
since at least mid -December.

I was able to chat with Charles.
First, Scott did not include an off -site temporary construction easement on the recently submitted easement plat
(SUB2021-22) for Berkmar Overlook.
However, Charles is okay with them using this letter (once it is correct and the correct exhibit is attached) in place of an
off -site easement for the adjoining property.
Second, we have issues with what they did with the letter:
1. The wrong version of the site plan was referenced (8/31/2020). They need one that shows all the changes
discussed in our meeting in December.
2. The agreement letter references a Pre -manufactured shelter being added to the Child Development Center's
site, and that improvement does not appear to have been shown on either the Site Plan or the Road Plan. If it is
a proposed improvement it is supposed to be shown so that this site plan can be utilized in leu of an LOR for the
adjoining site.
3. If the agreement has an attached exhibit (as the 2/17/2021 states it had), the attached exhibit should be part of
the PDF that is submitted to the County for our documentation purposes. Otherwise we can not see what they
have agreed to.
Third, as discussed with Charles, we will leave it up to Scott Collins (and his clients) whether for the site plan
review/approval process he wants to use this agreement document (once it is revised) or if he wants to add a temporary
construction easement to the already under review easement plat (that could be added prior to the next submission of
the easement plat after they receive the 1" round comments). The adjoining owners in that case would have to either
sign the plat or sign a deed of easement referencing the plat, which of course would have to be recorded.
Now it is just a matter of if getting a new/revised legal document drafted and signed by the adjoining owners will slow
down the Road Plan approval or if engineering needs most (if not all) of the changes planning needs before you can
approve the Road Plan as well.
That likely will be the main deciding factor for Scott.

Well... I hate to say this, but there is a problem with the agreement.
It says the 8/31/2020 site plan (see attached).
That was prior to the most recent changes to address the issues with the adjoining property having insufficient parking.
It does not show all the area and changes that are now part of the road plan and site plan...

At this point, Berkmar Overlook ROAD Plan approval devolves to RWSA review comments. Planning, VDOT, ACSA,
ACF&R, GIS, and Engineering (except for need for signed off -site letter) review comments have been addressed. Yet with
latest ROAD Plan submittal, there is a discrepancy between the approved WPO plan, and ROAD Plan. We need help with this
Although we've hit a late -stage, tree/RWSA waterline conflict, review staff is committed to work thru this as quickly as
possible. Please examine images, below (WPO /ROAD Plan). Please compare approved WP02019-00050, Sheet 11 (detention
basin /SWM facility access) with ROAD Plan, sheet 19, 12/11/2020. The ROAD Plan cannot effect change to an approved
SWM facility (basin contours, or access). Rather, a ROAD, Site, and WPO Plan should be consistent with one another. A
WPO Plan Amendment is required for this type alteration of an approved SWM facility. Please take a moment; if this strikes
you as odd, please advise as to what direction you would like to go (ROAD consistent with approved WPO, or WPO Plan
Amendment). Better, if this is something easily explained, then that could move us closer to ROAD Plan approval. There is, of
course, the issue of tree plantings, which may need to be > 15' from 30" RWSA water main. Again, there is a
discrepancy. Once ROAD/WPO discrepancy is addressed, please work with Dyon to address RWSA review comments.

Although ACSA had no objection to the September Berkmar Overlook Road Plan submittal, it is possible this revised ROAD
plan may affect proposed utilities near development entrance off Berkmar Drive.
Please, if you've time in the next week or so, confirm that ACSA `No objection' comment remains valid. Attached is likely to
be the final ROAD plan. We just want to ensure ACSA has No objection.

Terrific, just what we needed. Once acceptable to RWSA, the road plan will be approved. Paty is point of contact on final plat
/ESP approval. The ROAD plan must be bonded (or Berkmar Overlook roads built to VDOT standards) prior to final plat
approval. I don't know order or precedence, final plat v. final site plan, but you've mentioned that in past email, and appear to
be in agreement with Planning, and Planning in agreement with you. I believe Ed Bailey is working with Ana on the ROAD

At this point, Berkmar Overlook ROAD Plan approval devolves to RWSA review comments. Planning, VDOT, ACSA,
ACF&R, GIS, and Engineering (except for need for signed off -site letter) review comments have been addressed. Yet with
latest ROAD Plan submittal, there is a discrepancy between the approved WPO plan, and ROAD Plan. We need help with this
Although we've hit a late -stage, tree/RWSA waterline conflict, review staff is committed to work thru this as quickly as
possible. Please examine images, below (WPO /ROAD Plan). Please compare approved WP02019-00050, Sheet 11 (detention
basin /SWM facility access) with ROAD Plan, sheet 19, 12/11/2020. The ROAD Plan cannot effect change to an approved
SWM facility (basin contours, or access). Rather, a ROAD, Site, and WPO Plan should be consistent with one another. A
WPO Plan Amendment is required for this type alteration of an approved SWM facility. Please take a moment; if this strikes
you as odd, please advise as to what direction you would like to go (ROAD consistent with approved WPO, or WPO Plan
Amendment). Better, if this is something easily explained, then that could move us closer to ROAD Plan approval. There is, of
course, the issue of tree plantings, which may need to be > 15' from 30" RWSA water main. Again, there is a
discrepancy. Once ROAD/WPO discrepancy is addressed, please work with Dyon to address RWSA review comments.

trees planted in SWM detention basin embankment, or within 25' wide emergency spillway.
Nearest approach of any canopy tree to SWM facility access would be no closer than mature tree canopy radius (half canopy

You will receive it in two different emails. This is the second of two.

Although ACSA had no objection to the September Berkmar Overlook Road Plan submittal, it is possible this revised ROAD
plan may affect proposed utilities near development entrance off Berkmar Drive.
Please, if you've time in the next week or so, confirm that ACSA `No objection' comment remains valid. Attached is likely to
be the final ROAD plan. We just want to ensure ACSA has No objection.

Can you place our WL on this sheet? Looking at an overlay I believe you pushed the trees in conflict back, but it is
difficult looking at two different sheets and we typically ask for our utilities to be shown on all relevant sheets. However

At this point, Berkmar Overlook ROAD Plan approval devolves to RWSA review comments. Planning, V]DOT, ACSA,
ACF&R, GIS, and Engineering (except for need for signed off -site letter) review comments have been addressed. Yet with
latest ROAD Plan submittal, there is a discrepancy between the approved WPO plan, and ROAD Plan. We need help with this
Although we've hit a late -stage, tree/RWSA waterline conflict, review staff is committed to work thru this as quickly as
possible. Please examine images, below (WPO /ROAD Plan). Please compare approved WP02019-00050, Sheet 11 (detention
basin /SWM facility access) with ROAD Plan, sheet 19, 12/11/2020. The ROAD Plan cannot effect change to an approved
SWM facility (basin contours, or access). Rather, a ROAD, Site, and WPO Plan should be consistent with one another. A
WPO Plan Amendment is required for this type alteration of an approved SWM facility. Please take a moment; if this strikes
you as odd, please advise as to what direction you would like to go (ROAD consistent with approved WPO, or WPO Plan
Amendment). Better, if this is something easily explained, then that could move us closer to ROAD Plan approval. There is, of
course, the issue of tree plantings, which may need to be > 15' from 30" RWSA water main. Again, there is a
discrepancy. Once ROAD/WPO discrepancy is addressed, please work with Dyon to address RWSA review comments.

would be wise to distribute the attached SDP2020-42 Final Site Plan for the project for you to review.
You had no objection to the 9/30 submission, so when I received the 12/1 submission I did not distribute it to you.
You will receive it in two different emails. This is the second of two.
FYI, it is likely that my comments for the 12/1 resubmittal of SDP2020-24 will likely go out tomorrow.
However, I will include in my comments that your comments are pending.

Although ACSA had no objection to the September Berkmar Overlook Road Plan submittal, it is possible this revised ROAD
plan may affect proposed utilities near development entrance off Berkmar Drive.
Please, if you've time in the next week or so, confirm that ACSA `No objection' comment remains valid. Attached is likely to
be the final ROAD plan. We just want to ensure ACSA has No objection.

At this point, Berkmar Overlook ROAD Plan approval devolves to RWSA review comments. Planning, VDOT, ACSA,
ACF&R, GIS, and Engineering (except for need for signed off -site letter) review comments have been addressed. Yet with
latest ROAD Plan submittal, there is a discrepancy between the approved WPO plan, and ROAD Plan. We need help with
this.
Although we've hit a late -stage, tree/RWSA waterline conflict, review staff is committed to work thru this as quickly as
possible. Please examine images, below (WPO /ROAD Plan). Please compare approved WP02019-00050, Sheet 11
(detention basin /SWM facility access) with ROAD Plan, sheet 19, 12/11/2020. The ROAD Plan cannot effect change to an
approved SWM facility (basin contours, or access). Rather, a ROAD, Site, and WPO Plan should be consistent with one
another. A WPO Plan Amendment is required for this type alteration of an approved SWM facility. Please take a moment; if
this strikes you as odd, please advise as to what direction you would like to go (ROAD consistent with approved WPO, or
WPO Plan Amendment). Better, if this is something easily explained, then that could move us closer to ROAD Plan
approval. There is, of course, the issue of tree plantings, which may need to be > 15' from 30" RWSA water main. Again,
there is a discrepancy. Once ROAD/WPO discrepancy is addressed, please work with Dyon to address RWSA review
comments.

The SWM facility Access must be clear (passable 10' width), with mature tree canopies not intruding on clear width, with no
trees planted in SWM detention basin embankment, or within 25' wide emergency spillway.
Nearest approach of any canopy tree to SWM facility access would be no closer than mature tree canopy radius (half canopy
diameter).

In light of the issue brought up today with SUB2020-4 Berkmar Overlook Road Plan (below in purple/italics) I thought
it would be wise to distribute the attached SDP2020-42 Final Site Plan for the project for you to review.
You had no objection to the 9/30 submission, so when I received the 12/1 submission I did not distribute it to you.
You will receive it in two different emails. This is the second of two.
FYI, it is likely that my comments for the 12/1 resubmittal of SDP2020-24 will likely go out tomorrow.
However, I will include in my comments that your comments are pending.
So, please just get them to me as soon as you are able.

Engineering anticipates revisions to carry thru to the final site plan. We request no additional ROAD Plan application
feels. Again, please send email (from RWSA) confirming Berkmar Overlook ROAD Plan is acceptable. Once notified, once
we receive signed letter with Child Development Center, we intend to approve Road Plan that day.
Then, once ROAD Plan is approved and bonded, once all final subdivision ( plat) review comments are addressed, the final

Although ACSA had no objection to the September Berkmar Overlook Road Plan submittal, it is possible this revised ROAD
plan may affect proposed utilities near development entrance off Berkmar Drive.
Please, if you've time in the next week or so, confirm that ACSA `No objection' comment remains valid. Attached is likely to
be the final ROAD plan. We just want to ensure ACSA has No objection.

• The changes you will be making to the right of way will have to be reviewed and approved by VDOT even though

discussed with the reviewer prior to resubmission, it can delay the process.

In reference to your remaining questions on #3 & 4, 1 will accept that the street frontage won't go through the
intersections.
However, even allowing for that the distances you were specifying did not seem correct.
Ensure they are not starting 30' from the intersection. Just because VDOT will not allow trees in the first 30' does not
mean that does not count as street frontage.
Is there anything else you need to know on #3 & 4?
In reference to submitting by PDF, we definitely want digital submissions whenever possible.
However, it will be put into the review cycle.
We are really doing the best we can, but other applicants are having to wait as well because these are unprecedented
times.
Also, when I look at the Road Plan review on County View I do not see where either VDOT or ACSA comments have
been logged in.
If that is just a clerical error on our part we will try to fix it, but at this time from looking at County View it does not
appear that the road plan review is close to approval.
The final site plan and final subdivision plat were submitted for the first review on 4/22.
They will be reviewed when we are able to do so, but please keep in mind that excepting things to be as fast as prior to
COVID19 is just not realistic at this time.
I am hopeful that the backlog will be clearing out soon, but right now things are still not at pre-COVID19 speeds.

As promised I reached out to ask others about the planting strip requirement on Berkmar Overlook,
and my Road Plan comments.
What I was told is that the planting strip is a requirement and that it is supposed to be between the
curb and the sidewalk.
So, the comment needs to be addressed.
This was a group virtual meeting with two management level planners attending.
In reference to the examples you provided, I would not consider them "approved".
It is an approved initial site plan, not a final site plan, and the road plan has not received the first round
of comments yet.
The issue must not have been caught during the initial site plan review.
Since the example you provided is from Brookhill before I brought the question to the group I reached
out to Cameron L.
He was part of the virtual meeting when it was discussed today.

As a follow-up to the sidewalk adjacent to the (3) single parking spaces, attached is an example on other
projects that have been acceptable. It appears that other planners are allowing it, but requiring the
sidewalk to be 8' wide in these locations. Can you confirm that this will be acceptable for this project as

Thanks for sending this over, I have some questions on your comments that I need some help with:
1. Comment #1—This comment does not seem necessary, as it applies to any county project.
2. Comment #2 - I've done this on other projects where we have a couple of single parallel parking
spaces along a roadway, and instead of weaving the sidewalk in and out, we just keep the
sidewalk consistent. It does not affect the planting strip for street trees, as the space occupied
by a parking space is only 20', and this creates a much more linear and uniform sidewalk instead
of weaving in and out. From a planning standpoint, this is a better design. Do I really need to
break the sidewalk and create a 6' offset for the (3) single parallel park spaces? Should I reach
out to Charles Rapp and get his insight on this?
3. Comment #5 — When calculating the Street Frontage for the street trees, we do not extend the
street frontage through an intersection of the streets. That is why your math is different than
mine for the street frontage. It's not street frontage in the intersections of a street, and this
area does not count toward the required street trees. Can we confirm that my calculations are
correct. In addition, street trees have to be a minimum distance of 30' from the intersection as
required by VDOT, which is why no street tree is located south of Empire Street intersection
with Berkmar Drive, as there is not enough room from the intersection for the tree. As far as
the easement along the powerline, there is no recorded easement language on the width of the
easement. We were holding 8.5' but can make it 10' from the overhead line, if that is
acceptable. That would put the trees 25' from the street.
4. Comment #6 —this is the same request as Comment #5, as we do not extend lot frontage
through the intersections for the calculations for the street trees.

Attached is the VDOT approval and ACSA approval. It's just planning at this point, and these are relatively limits

In reference to your remaining questions on #3 & 4, 1 will accept that the street frontage won't go through the
intersections.
However, even allowing for that the distances you were specifying did not seem correct.
Ensure they are not starting 30' from the intersection. Just because VDOT will not allow trees in the first 30' does not
mean that does not count as street frontage.
Is there anything else you need to know on #3 & 4?
In reference to submitting by PDF, we definitely want digital submissions whenever possible.
However, it will be put into the review cycle.
We are really doing the best we can, but other applicants are having to wait as well because these are unprecedented
times.
Also, when I look at the Road Plan review on County View I do not see where either VDOT or ACSA comments have
been logged in.
If that is just a clerical error on our part we will try to fix it, but at this time from looking at County View it does not
appear that the road plan review is close to approval.
The final site plan and final subdivision plat were submitted for the first review on 4/22.
They will be reviewed when we are able to do so, but please keep in mind that excepting things to be as fast as prior to
COVID19 is just not realistic at this time.
I am hopeful that the backlog will be clearing out soon, but right now things are still not at pre-COVID19 speeds.

As promised I reached out to ask others about the planting strip requirement on Berkmar Overlook,
and my Road Plan comments.
What I was told is that the planting strip is a requirement and that it is supposed to be between the
curb and the sidewalk.
So, the comment needs to be addressed.
This was a group virtual meeting with two management level planners attending.
In reference to the examples you provided, I would not consider them "approved".
It is an approved initial site plan, not a final site plan, and the road plan has not received the first round
of comments yet.
The issue must not have been caught during the initial site plan review.
Since the example you provided is from Brookhill before I brought the question to the group I reached
out to Cameron L.
He was part of the virtual meeting when it was discussed today.
I know that is not the response you wished to receive, but I hope it answers your question.

As a follow-up to the sidewalk adjacent to the (3) single parking spaces, attached is an example on other
projects that have been acceptable. It appears that other planners are allowing it, but requiring the
sidewalk to be 8' wide in these locations. Can you confirm that this will be acceptable for this project as
well, and I will widen it to 8'.

Thanks for sending this over, I have some questions on your comments that I need some help with:
1. Comment #1—This comment does not seem necessary, as it applies to any county project.
2. Comment #2 - I've done this on other projects where we have a couple of single parallel parking
spaces along a roadway, and instead of weaving the sidewalk in and out, we just keep the
sidewalk consistent. It does not affect the planting strip for street trees, as the space occupied
by a parking space is only 20', and this creates a much more linear and uniform sidewalk instead
of weaving in and out. From a planning standpoint, this is a better design. Do I really need to
break the sidewalk and create a 6' offset for the (3) single parallel park spaces? Should I reach
out to Charles Rapp and get his insight on this?
3. Comment #5 — When calculating the Street Frontage for the street trees, we do not extend the
street frontage through an intersection of the streets. That is why your math is different than
mine for the street frontage. It's not street frontage in the intersections of a street, and this
area does not count toward the required street trees. Can we confirm that my calculations are
correct. In addition, street trees have to be a minimum distance of 30' from the intersection as
required by VDOT, which is why no street tree is located south of Empire Street intersection
with Berkmar Drive, as there is not enough room from the intersection for the tree. As far as
the easement along the powerline, there is no recorded easement language on the width of the
easement. We were holding 8.5' but can make it 10' from the overhead line, if that is
acceptable. That would put the trees 25' from the street.
4. Comment #6 —this is the same request as Comment #5, as we do not extend lot frontage
through the intersections for the calculations for the street trees.
