X, 2 f6e Signature ate Receipt# Date g P � Setback Variance Request Justification Jouett Middle School Addition January 7, 2002 1) That the strict application of this ordinance would produce undue hardship. A 25' setback for the existing internal public roadway (current bus loop for Greer Elementary School) is an undue hardship since to meet the setback would necessitate more costly disturbance to the site; The proposed addition is sited on the level area directly adjacent to existing Jouett school, graded in anticipation of a future addition(although not shown on any "approved Plans". Specifically the other options include: a) Relocation to the area of the existing tennis courts (increasing the disturbed area within the South Rivanna Reservoir watershed. The tennis courts could not be relocated, causing hardship to students by reducing recreation/athletic activity. b) Relocation in the woods to the north of the existing building. This would, likewise, increase the disturbance to the existing wooded slope leading to the Ivy Creek, and Rivanna watershed. In addition, the outdoor amphitheater would no longer be available, causing hardship to the students. 2) That such hardship is not shared generally by other properties in the same zoning district and the same vicinity. This hardship is not generally shared, since only schools have this unusual "hybrid" of state road for the bus loop. (i.e. VDOT maintains the road, but it is simply the school bus loop - not a typical secondary subdivision roadway in the State System). This variance is for the setback from the bus loop, which also qualifies as an internal public road(according to the ordinance). 3) That the authorization of such variance will not be of substantial detriment to adjacent property and that the character of the district will not be changed by the granting of the variance. This request is of no detriment to adjacent property. This project is in the middle of a 200 acre parcel.
