McCulley PUBLIC HEARING: March 5, 2002 STAFF REPORT VA-2002-003 OWNER/APPLICANT: Sherri Ryder, Christopher Robbins and Rebecca McAgree TAX MAP/PARCEL: 46 / 32F ZONING: RA, Rural Areas ACREAGE: 1.13 acres LOCATION: On the east side of Route 649 between Chesterfield subdivision and Lanford Drive at 2677 Proffit Road. TECHNICAL REQUEST AND EXPLANATION: This variance request and review will be divided into two parts: A is variances resulting from a redivision between two nonconforming lots and B is a variance to correct an existing technical violation of setback. A. The applicants propose to reconfigure two nonconforming lots (parcels 32F and 32D) by shifting the property line between them. The proposed redivision results in 0.257 acres from parcel 32F to be added to become a part of parcel 32D. This redivision necessitates the following variances: 1. A reduction in lot frontage from 250 to 138 feet on Route 649, a variance of 112 feet. (Parcel 32F currently has 173 feet of frontage and will lose 35 feet of frontage with the area to be added to become a part of parcel 32D.) This is a variance of Section 10.4 Area and Bulk Regulations. 2. A reduction in lot width from 250 to 125 feet at the front building line. (Again, this results from the area which will be added to become a part of parcel 32D.) 3. An increase in slope allowed for the septic reserve from under 25% to 35%. (The area to be added to become a part of parcel 32D does not include available area for septic reserve. This will be more fully explained in the proceeding.) 4. A reduction in lot size from 2.0 acres required by the ordinance and 1.13 acres in the current nonconforming lot, to 0.8 acres. (This reduction in lot size is the area to be added to parcel 32D.) B. This variance request includes a correction to an existing technical violation in the side yard setback for a house built in 1978. The house on parcel 32F is currently located 3.5 feet from the side property line adjacent to parcel 33G, located to the south. Therefore, they request a variance to reduce the side yard setback from 25 to 3.5 feet, a reduction of 21.5 feet from Section 10.4 Area and Bulk Regulations. VA 2002-003 Ryder, Robbins & McAgree March 5, 2002 2 RELEVANT HISTORY: This is a case in which the history is directly related to the variance request; therefore, it will be explained in greater detail than is typical. This is taken in large part from the applicants' submittal letter. 1. In 1962, James and Edith Rice divided property they owned into six (6) lots. (See plat as Applicants' exhibit A) Sometime later, they built a house on lot 4. 2. In 1978, James and Edith Rice built a house on Lot 6. This is the house on the subject property. The house placement violates side and front yard setbacks. A variance for the front yard violation was approved by the Board of Zoning Appeals in 1978; however, the side yard violation was not addressed. 3. In 1989, James and Edith Rice provided a septic drainfield easement across lots 4 and 5 and a small portion of lot 6 for the benefit of lot 3. They also eliminated lot 5 by combining part of lot 5 with lot 4, calling the resulting parcel lot 4A and combining the remaining portion of lot 5 with lot 6, calling the resulting parcel lot 6A. The septic drainfield easement and the creation of lots 4A and 6A (and resulting elimination of lot 5) were done by a plat dated November 20, 1989. 4. In 1997, Edith Rice, now a widow, conveyed to her daughter, Judy Rice Robbins, the 1978 house and lot 6. Unfortunately, the 1997 deed incorrectly referred to the property conveyed as lot 6 as shown on the 1962 plat and should have referred to the property as lot 6A as shown on the 1989 plat. 5. In the spring of 2001, Judy Rice Robbins died and her three children placed the Robbins property on the market for sale. They signed a contract to sell the property and the buyer obtained a survey from Roger Ray. At that time, the error in the 1997 conveyance was discovered. Therefore, the grandchildren now own lot 6 as shown on the 1962 plat and Edith Rice continues to own a portion of lot 5 and all of lot 4A. When the 1997 conveyance error was brought to the attention of Edith Rice and she reviewed the plats, she took the position that the lot line configuration that was created by the 1989 plat was in error and that when she conveyed the house and property to her daughter in 1997, she thought there was a different boundary line. Consequently, she would not agree to execute a new deed of conveyance to clear the title problem. Negotiations continued between Edith Rice and the grandchildren to reestablish the boundary line. Ms. Rice has agreed to the reconfiguration as shown on exhibit F and as reflected by this variance request. The basis for this new property line will be explained more fully in the proceeding. PROPERTY DESCRIPTION AND QUALIFYING CONDITIONS: The subject property (parcel 32F) is improved with a single-family detached residence. As noted, this residence was built in 1978. The property is relatively level adjacent to Route 649 in the front yard and it slopes down to a creek in the rear. It is in the critical slopes in the rear that the septic reserve area is located. VA 2002-003 Ryder, Robbins & McAgree March 5, 2002 3 Parcel 32D or lot 4A is the adjoining property owned by grandmother, Edith Rice. This property currently consists of 0.67 acres. It is also improved with a single-family detached residence. It shares the same topographic constraints with steep wooded area to the rear. Staff was initially concerned that the loss of land by parcel 32F could diminish the building site and available septic reserve area. The area (0.257 acres) being lost by parcel 32F is substantially involved in an existing septic easement for lot 3 and practically is not an available building or septic area. The septic reserve area on parcel 32F is extremely limited by the lot size, existing development and the stream. The proposed area for septic reserve appears to be the only and most logical septic reserve area available. The house on lot 6A was built prior to the current zoning ordinance and these lots were originally platted prior to zoning in Albemarle. These variances will not enable further development of the properties; they are currently both built. The variances will resolve a violation and an error in property conveyance. It appears that the proposed lot reconfiguration is practical and will not be detrimental to either property. For these reasons, staff recommends approval. APPLICANT'S JUSTIFICATION AND STAFF COMMENT: A review of the variance criteria provided by the applicant and comments by staff follows: Hardship Staff comments are written in italics and follow the applicant's comments. The applicant notes that the variance is necessary: • The property will be worthless and unmarketable without the variance. This is the most logical way to resolve the title problem with the conveyance of the incorrect property description. Other methods would include a court-ordered partition and may not meet County goals and standards. The proposed property line shift will make parcel 32D more conforming and is a logical addition to that property. The loss of this area does not seem to be detrimental to parcel 32F. With regards to the setback violation, staff finds this to be a hardship. This is a case of mutual mistakes in which both the County and the owner have responsibility. It is more surprising in this case since the front setback encroachment was handled by a variance at that time. Because the adjoining property owners are not willing to shift the property line and reduce or eliminate the building encroachment, these owners are in an untenable position. VA 2002-003 Ryder, Robbins & McAgree March 5, 2002 4 1. The applicant has provided evidence that the strict application of the ordinance would produce undue hardship. Uniqueness of Hardship The applicant notes: • The property contains a single family residence that was built in 1978. A variance was approved in 1978 for the front yard setback violation shown on the plat. The side yard setback violation was discovered in 2001 as well as the title issue creating the need to adjust the boundary line. Staff notes that it is not a typical situation to have this set of circumstances. The reconfiguration or redivision of nonconforming lots can be a challenging review. It is also unique that in this situation, the owner of one of the parcels is unwilling to restore the former property lines shown in the recorded plat of 1989. With regards to the side yard setback encroachment, it is also a unique situation. It is atypical for someone to build a house and go through a front setback variance review— while all parties miss another area of significant encroachment. Staff finds unique circumstances with respect to both components of the variance request. 2. The applicant has provided evidence that such hardship is not shared generally by other properties in the same zoning district and the same vicinity. Impact on Character of the Area The applicant offers: • The variance request addresses an existing house and lot, nothing new will be constructed. The slope restrictions only pertain to septic reserve area — construction of a new system is not contemplated. Staff suggests that there will be no visible change and no actual development authorized by the approval of these variances. This does not appear to detrimentally impact either area of the adjoining properties. 3. The applicant has provided evidence that the authorization of such variance will not be of substantial detriment to adjacent property and that the character of the district will not be changed by the granting of the variance. Should the Board find cause to approve it, staff recommends the following condition: This variance approval is based on the proposed lot reconfiguration submitted.
