McAgree Tax Map 046, Parcel 32F Dear Mr. Cochran: The Albemarle County Board of Zoning Appeals heard your variance request, VA-2002-003, at their public hearing on Tuesday, March 5, 2002. The Board voted (4:0) to approve the variance subject to the following conditions: 1) This variance approval is based on the proposed lot reconfiguration submitted. Any variation from those property lines that are not considered in substantial accord by the Zoning Administrator shall be subject to review by the Board of Zoning Appeals. 2) Provided that moving the lot line between lots 4 and 6 will not cause any part of the primary drainfield from lot 6 to impose upon lot 4 unless a legal easement is executed. 3) In connection with the side yard variance, the existing wall which is on the adjoining property must be removed by the applicant and any portion of the driveway which imposes upon the adjoining property shall be removed. 4) The new line between lots 4 and 6 shall not be closer than 6 feet to the existing shed. March 8, 2002 This approval grants relief from Sections 10.4 and 4.6.1.3 of the Albemarle County Zoning Ordinance to allow the applicants to reconfigure the lots by reducing parcel 32F by 0.257 acres which will be added to parcel 32D as follows: 1) Reduce lot frontage from 250 to 130 feet on Rt. 649, 2) Reduce lot width from 250 to 125 feet at front building line, 3) Allow septic reserve area(5,600 sq. ft) on critical slopes (35%), 4) Reduce lot size from 1.13 acres (nonconforming) to 0.8 acres, and 5) Reduce side setback from 25 to 3 ft. on western side of property.
