...The Albemarle County Board of Zoning Appeals will conduct a public hearing
on the following appeal and variance requests on March 5, 2002 at 2:00 PM, in
Meeting Room 241 , 2nd FI, County Office Building, 401 McIntire Road,
Charlottesville, VA:
VA 2002-003 (Sign # 15) — Ryder, Sherri R. & Christopher N. Robbins &
Rebecca R. McAgree (owners); Joseph M. Cochran, Esquire (applicant)
Located on the E side of Rt 649, approx. 1/10 mi. NE of inters. of Lanford Dr. &
Rt 649 at 2677 Proffit Road. TM 46/Parcel 32F, zoned Rural Areas. Request to
reconfigure lots by reducing parcel 32F by 0.257 acres to be added to parcel
32D. This results in the following variance requests: 1) Reduce lot frontage
from 250 to 130 feet on Rt. 649, 2) Reduce lot width from 250 to 125 feet at front
building line, 3) Allow septic reserve area (5,600 sq. ft) on critical slopes (35%),
4) Reduce lot size from 1 .13 acres (nonconforming) to 0.8 acres, and 5) Reduce
side setback from 25 to 3 ft. on western side of property.
AP-2001-010 (Sign #11) — Edwin E. and Ruby D. Wade
(applicants/appellants) appeals the Zoning Administrator's determination that
inadvertently unassigned aggregate acreage of development rights will be
permitted to be used in the order in which it is submitted to the County for new
plat approval. Appellant claims any reduction of their division rights reduces the
property value and amounts to a taking without compensation. Their property is
located on the NW side of Rt. 231 , approximately '/4 mile north of its intersection
with Rt. 615. TM 51/Parcel 2C, zoned Rural Areas.
AP-2001-012. (Sign # 3) F. Ronald Cutright (appellant), appeals the Zoning
Administrator's determination of violation that the accumulation of concrete within
the flood plain requires a special use permit for fill material under Section
30.3.05.2. Appellant states that concrete was used as rip-rap on stream bank for
erosion control. Located on SW side of Rt. 708, approx. 1/10 mi. SE of its inters.
w/ Rt. 29S (2444 Red Hill Rd), TM 088/Parcel 8, zoned Rural Areas.
