RE: OFFICIAL DETERMINATION OF "SIMILAR STRUCTURE" Section 4.11.2.3
Dear Mr. Pietro:
You have submitted a sketch of a structure and asked if it could be considered a "similar
structure" as provided in Section 4.11.2.3 of the zoning ordinance. I understand from our further
conversation that it would feature 6" x 6" posts with a 2" x 8" roof system and that it would be
either 10' x 14' or 12' x 12'. A copy of the sketch is attached to this determination. Section
4.11.2.3 is provided here for your reference:
4.11.2.3 FENCES, MAILBOXES, AND SIMILAR STRUCTURES
Fences, free-standing mail and/or newspaper boxes, signs advertising sale or rent of the
property, and shelters for school children traveling to and from school shall be permitted in all
districts and shall be exempt from all setback and yard requirements except as otherwise
provided in section 4.4. For the purposes of this section, the term "fence" shall be deemed to
include free-standing walls enclosing yards and other uncovered areas. (Addition 3-18-81)
It is my official determination that the structure shown on the attached sketch and further
described above is not a "similar structure" as provided in Section 4.11.2.3. Therefore it is not
exempt from setback and yard requirements.
If you are aggrieved by this determination, you have a right to appeal it within thirty days of the
date notice of this determination is given, in accordance with Section 15.2-2311 of the Code of
Virginia. If you do not file a timely appeal, this determination shall be final and unappealable.
An appeal shall be taken only by filing with the Zoning Administrator and the Board of Zoning
Appeals a notice of appeal which specifies the grounds for the appeal. An appeal application
must be completed and filed along with the fee of $95. The date notice of this determination
was given is the same as the date of this letter.
