Hawkins 2414 Huntington Road Charlottesville, VA 22901 RE: Board of Zoning Appeals Action AP- 2007 -007 - Ellen F. Hawkins (owner /appellant) Tax Map 62A1, Block A, Parcel 4 Dear Ms. Hawkins: At their meeting on January 8, 2008, the Board of Zoning Appeals voted 3 -1 to modify the Zoning Administrator's determination dated October 16, 2007. The determination stated the following: the onsite inspection revealed the presence of approximately fifteen (15) adult dogs, seven (7) puppies, portable kennels, cages, bulk amounts of dog food and other related material contained within the structure. The inspection also revealed approximately twelve (12) adult dogs, portable cages, kennels and bulk amounts of related material throughout the parcel. The number of animals and the volume and storage of material related to their care on this parcel constitutes a use not permitted. The determination was modified as follows: The Board upheld the Zoning Administrator's determination in relation to any and all the transient dogs and the equipment that goes with them. The Board found that the animal rescue operation is not a permitted accessory use. The Board overruled the Zoning Administrator's determination as far as Ms. Ellen Hawkins' personal pets that are permanent residents at her home. The permanent dogs need to be licensed to Ms. Ellen Hawkins. If you are aggrieved by this decision, you have the right to appeal it within thirty (30) days of the Board's January 8, 2008 decision, in accordance with Section 15.2 -2314 of the Code of Virginia. If you do not file a timely appeal, this decision shall be final and unappealable. An appeal shall be taken only by filing a petition specifying the grounds on which aggrieved with the Circuit Court of Albemarle County within the prescribed thirty (30) days.
