Request a reduction of required front setback for nonconforming structures from 25 ft to ) 20 ft, a variance of 5 ft to allow construction of a covered porch on the side of a dwelling. TM 127/Parcel 12A, zoned Rural Areas. DESCRIPTION OF REQUEST: — I am requesting a variance to the setback requirements which prevent construction within — 25 feet of the edge of the right of way of a secondary state road. I am seeking the — variance for the sole purpose of constructing a covered porch with steps on the South side of the existing house. The construction of this porch will effectively move the main — entrance to the house. JUSTIFICATION SHALL BE BASED ON THESE THREE (3) CRITERIA: 1) That the strict application of this ordinance would produce undue hardship. The strict application of this ordinance will prevent me from moving the main entrance to the side of the existing house and further away from the state road. Moving the main entrance will reduce pedestrian traffic and any obstructions associated with it in the area between the existing porch and the state road. Reducing the pedestrian traffic and/or any obstructions associated with them will help to create a safer situation for those traveling on Old Sand Road as well as the occupants of the house and their guests. Please see attached drawings. 2) That such hardship is not shared generally by other properties in the same zoning district and the same vicinity. This building was originally used as a church and, according to the previous owner, was converted to a 3 bedroom dwelling in the 1970's. I haven't done extensive research, but the house seems to be closer to the road than most houses in the area. Please see the attached pictures. 3) That the authorization of such variance will not be of substantial detriment to adjacent property and that the character of the district will not be changed by the granting of the variance. Permitting the variance will benefit adjacent property owners as they are likely to experience fewer obstacles close to the road. Also, the appearance of the house will be improved and the property's value will go up. And, if the character of the district is changed by the granting of the variance, it will be changed for the better! The application may be deferred by the staff or the Board of Zoning Appeals, if sufficient information necessary to this revi has not be submitted by the deadline.
