DESCRIPTION OF REQUEST To utilize my two development rights as a rural division with 204 feet of road frontage to be donated by the neighbor across the street. To create an easement for a driveway to serve the two lots while keeping my own driveway which I paid to have paved several years ago. JUSTIFICATION 1.UNDUE HARDSHIP—To allow me to use my development rights without going through a costly subdivision process which seems unnecessary because I had 522 feet of frontage&this would have qualified as a rural division before the realignment of VSH 53. ' 2. NOT SHARED GENERALLY—this is a unique situation 3. NOT A DETRIMENT TO ADJACENT PROPERTY- the neighbors across the street, Betty Eppard and Henry Eppard, give their support as evidenced by the attached letter of intent. No detriment to anv property is intended. My 25.54 acre property, which is my `homeplace' has 3 division rights, according to Yudira Amarante from the planning department. One of these rights has to go with my house, and two rights remain. I would like to sell 2 lots toward the rear of the property behind the cemetary as marked on the attached survey. I plan to create an easement across my land for the driveway *. Historically, this property had over 522+feet of road frontage on VSH 53. I owned to the center of the road. Then, VSH 53 was realigned and this caused me to lose entirely all my road frontage. Apparently, my existing driveway is grandfathered. I want to keep my driveway, which I paid to have paved several years ago. I want to make another driveway in a better location down the road towards the store to serve the 2 lots I want to create. I need permission for the driveway and permission to create the 2 lots. I was told I would have had the correct road frontage under the rural division program if VSH had not been moved and my road frontage lost. My neighbor across the street has agreed to give me the thin strip of land that now runs between the centerline of new VSH 53 and the centerline of the old VSH 53. I can't tell from the plat, but Yudira Amarante added up the frontage to be donated to me and said it was 204'. Please see the attached plat by Frank A. Gregg. *(This site has been visited and driveway location approved by Mr. Baber from the VDOT, driveway to be located across street from neighbors entrance at 2196 Thomas Jefferson Pkwy owned by Eppards, who are donating the land.) (TM 93, parcel 40C) A copy of our survey which was done by Frank A. Gregg in 1986, is attached. Our land did share a mutual boundary, which was the centerline of VSH 53. However, old VSH 53 was realigned, and the centerline of the new road is now entirely on our property. This realignment of the road away from Mrs. Payne's property means we now own a thin strip of land between the road and her property, depriving her of road frontage. It is our intention to rectify this situation by giving her this strip of land. We will do this by signing the soon to be created survey, which will show this transfer, and which will then be put to record. It is our understanding that she hopes to create two lots on the rear of the property, and that she would need to have road frontage to put in a driveway to provide access to the lots.
