V uuniu 4)0THEq,4i Southern Development Builders and Developers May 14, 2002 Department of Zoning Albemarle County 401 McIntire Rd Charlottesville,Virginia RE: VA-2002-010 and VA-2002-011 Variance Application for Deck Setbacks for Two Townhouses in Chatham Wood of River Run Ladies and Gentlemen: After reviewing the staff report I have a couple of issues I would like to address: Decks on other units in the D Block: The only decks in question are the two for which the variance was applied for. The shape of the other lots wrapping the cul-de-sac did not create a space constraint Future decks for E Block and C Block: The E Block will be constructed in a manner that allows for at- grade access with a level concrete patio. Our conceptual plans for the C Block include a two-story building with at-grade concrete patios in the rear. Construction of an at-grade patio on the D Block: Drainage requirements for the back of the block of buildings call for the grade to slope two ways—away from the building one direction (towards the retaining wall), and towards the E Block in the other direction. This prohibits an at-grade concrete patio. We did,however, construct our decks as close to grade as possible. Additionally, due to grade restraints, code requires stairs to exit from the doorway with a 3'x3' landing rendering most of the space unusable. However, as shown above, the topography dictates there is no option to construct an outdoor patio. Because the lots wrap the cul-de-sac, setbacks are difficult to work with. Impact on character of the area: Since the units look directly into a 10' tall retaining wall and then up a steep slope, the effect of an approval would not generate any impact on the character of the area nor the comfort of the neighbors.
