TAX MAP/PARCEL: 40/18 ZONING: RA, Rural Areas ACREAGE: 0.764 acres LOCATION: Located on west side Route 810 approximately 7/10 of a mile south of the intersection with Route 811 TECHNICAL REQUEST AND EXPLANATION: The applicant requests relief from Section 10.4 Area and Bulk Regulations to reduce the side setback from 25 to 10 feet, a variance of 15 feet and to reduce the rear setback from 35 to 26 feet, a variance of 9 feet, in order to enclose an existing covered porch. RELEVANT HISTORY: County real estate records indicate this dwelling was built in 1925 and that Parcel 18 was created in 1927. The covered porch was built in 1988. The applicants acquired the property in 1995. PROPERTY DESCRIPTION AND QUALIFYING CONDITIONS: This 0.764 acre parcel is improved by a dwelling, a frame garage and a vinyl pool. It is staff opinion that the owners now enjoy reasonable use of their property. Therefore, it is staff's opinion that this request does not meet the criteria for a finding of undue hardship. However, there are other factors the Board may wish to consider. This is a legal, nonconforming parcel because it was created prior to the adoption of the ordinance and contains less than 2 acres. On the date of adoption of the zoning ordinance it was also legally nonconforming with respect to the 25 foot side setback because the original house is located 17.3 feet from the south side property line. In 1988, a former owner added a wrap-around, covered porch to the southwest corner of the house. This addition was located 10 Y feet from the side and 26 feet from the rear. This application presents two issues; a remedy to the violation of the side and rear setbacks in 1988 and the current request to permit the enclosure of the porch. Now that this Department has been made aware of this encroachment, it will be necessary to pursue it as a violation. Approval of this request will abate the violation. Denial of this request will require that the existing porch be removed. Staff notes that the current owners acquired this property in good faith and had nothing to do with the construction of the porch within required setbacks. VA-2002-013 Murray 2 June 4, 2002 APPLICANT'S JUSTIFICATION AND STAFF COMMENT: A review of the variance criteria provided by the applicant and comments by staff follows: Hardship Staff comments are written in Italics and follow the applicant's comments. The applicant notes that the variance is necessary: It is our understanding that our property was parceled off before the existence of the existing ordinances regarding set back and size of property. The strict application of this ordinance does not take into account the age of this home and the time it was placed in this location on the property, thus we are under an undue hardship to adhere strictly to this code. Staff is sympathetic to the applicants'request because the property was acquired in good faith and without knowledge that the porch addition violated the side and rear setbacks of the district. If this request is denied, the existing covered porch must be removed to bring the property into conformance. This would indeed be a hardship for the current owners, but one that was self-imposed by the former owner of the property. This circumstance does not meet the standard for hardship as described in the code of Virginia that supports the granting of a variance. Likewise, the enclosure of the existing porch would be considered a convenience to the applicant rather than a hardship as described by the code. Taking both aspects of this request into account, staff cannot identify a hardship that supports the granting of a variance. 1. The applicant has not provided evidence that the strict application of the ordinance would produce undue hardship. Uniqueness of Hardship The applicant notes: Other properties in the same zoning district and the same vicinity do not share the same hardship. The properties are either larger, or they were parceled off at a time after current ordinances were in place. Staff agrees that the relatively small size of this parcel as well as the location of the house near the rear setback and within the side setback reduce the area available for additions to this dwelling. The applicant has not provided evidence that such hardship is not shared generally by other properties in the same zoning district and the same vicinity. Impact on Character of the Area The applicant offers: The planned enclosure will not be detrimental to the surrounding farmland. In fact, our neighbor has agreed to write a letter in support of the enclosure. The character of the district will not be changed at all. The enclosure will be all but unseen, except from behind and the cows in the field probably won't mind. Staff agrees with the applicant that this request will not have a negative impact on the character of the area or on adjacent property. The parcel is surrounded by the pasture located on Parcel 13B. The porch does not appear to be visible from any other dwelling. The porch has existed since 1988 and this approval does not allow an expansion. 3. The applicant has provided evidence that the authorization of such variance will not be of substantial detriment to adjacent property and that the character of the district will not be changed by the granting of the variance. STAFF RECOMMENDATION: Since only one of the three criteria for approval have been met, staff cannot recommend approval of this request. Should the Board find cause to approve this request, staff recommends the following condition: 1. This variance is for the enclosure of the existing porch as described in this file only. Any future additions or replacements will be subject to the setback and yard regulations in effect at the time of application.
