JUSTIFICATION STATEMENT
Description of request:
L. F. Wood, Jr., the owner of Tax Map Parcel 79-9, where the Shadwell Store is
located, has filed a Site Plan application requesting approval to redevelop the property
with a replacement Shadwell market (SDP #2002-025). To date, County Planning Staff
has approved the preliminary site plan he has submitted, with the exception of two
details: he proposes, by necessity, to locate a septic drainfield and stormwater detention
basin on a portion of Parcel 9 which is south of Route 250 and which is zoned RA, or
Rural Areas. The portion of his property on which the store now sits and on which the
replacement store is proposed to be constructed is north of Route 250 and is zoned Cl,
Commercial. Other than being physically separated by Route 250 and having been
assigned different zoning classifications since 1980, the two portions of his property have
always been treated as one tax map parcel (except for a brief period when they were
erroneously treated as two parcels and one was put in the name of the Highway
Department) and have in the past and continue to be taxed by Albemarle County as one
parcel which is zoned C l.
In a June 6, 2002 official determination letter, Amelia G. McCulley, Zoning
Administrator of Albemarle County, has determined that the septic drainfield and
stormwater detention basin cannot be located on the portion of Parcel 9 south of Route
250 because, under the Zoning Ordinance, these uses are not permitted in an RA district
as accessory uses to a commercial use.
A"Variance," as defined in the Albemarle County Zoning Ordinance, is "a
reasonable deviation from those provisions regulating the size or area of a lot, or the size,
area,bulk or location of a structure when the strict application of this chapter would
result in unnecessary or unreasonable hardship to the land owner, and the need for the
variance would not be shared generally by other lots, ...." Pursuant to Section 34.2 of the
Zoning Ordinance, the Board of Zoning Appeals has the authority to grant a variance
when it finds that the strict application of the Ordinance would produce undue hardship,
that such hardship is not shared generally by other properties in the same zoning district
and same vicinity, and that the authorization of the variance will not be of substantial
detriment to the adjacent property and the character of the district will not be changed by
the granting of the variance.
Justification Criteria:
1. The Strict Application of this interpretation of the Zoning Ordinance would
produce undue hardship.
The strict application of this interpretation of the Ordinance in this instance will
produce undue hardship because it will deprive Mr. Wood of the ability to provide
septic drainfields and stormwater detention facilities for the portion of Parcel 9 which
is zoned Cl, and will therefore make it impossible for him to redevelop the site. Due
to the unusual size and shape of this northern portion of the parcel and futher given its
physical separation from the southern portion of the parcel, he lacks adequate space
on the northern portion of the property where the Market is located to install
drainfields or a stormwater detention pond. Additionally,because there was a
drainfield on the norther portion of the parcel at one time, there is no longer soil on
site which will support a drainfield adequate to serve the Market.
While septic drainfields and stormwater detention ponds are not permitted as an
approved use for any property in an RA districts or specifically permitted in any other
zoning districts, they are approved as accessory uses if they are required to support
other approved uses, such as residential use. Thus, if Mr. Wood constructed a
residence on the portion of Parcel 9 that is south of Route 250, he could obtain
approval to construct a drainfield to serve that residential use. It yields a somewhat
illogical result that because he needs a drainfield to support a commercial us on that
same parcel of property, he cannot obtain that approval because the two portions of
the parcel have been zoned differently.
Additionally, since the entire parcel has been taxed for many years as commercial
property and Mr. Wood has paid those taxes without protest, it imposes a hardship to
not permit him to use the RA portion of the parcel for a drainfield.
2. Such hardship is not shared generally by other properties in the same zoning
district in the same vicinity.
Mr. Wood is not aware of any other properties in the vicinity of his property or in the
same zoning district that share this same hardship.
3. The authorization of a variance will not be of substantial detriment to adjacent
property and the character of the district will not be changed by granting the
variance.
Because granting the variance will allow an improvement which will not even be
visible from adjacent properties, authorizing the variance will not be of substantial
detriment to adjacent properties. Groundwater has historically flowed from Mr.
Wood's market property, under Route 250, and onto the property south of Route 250,
so what Mr. Wood is requesting will not alter natural flows of groundwater in any
way. The granting of the requested variance will not be of any substantial detriment
to adjacent property.
Granting the variance will also not change the character of the district. Since the
septic field and drainage basin proposed for the southern portion of the parcel will not
be visible from adjacent properties, there is no visible change in the use. There will
be no increase in customers or traffic relating to a drainfield or stormwater detention
pond. All commercial activities will be conducted on the northern portion of the
parcel, so there will be no impact on the character of the district.
