Re: Variance 2002-015 - Shadwell Market — Rejection of Application
Dear Mr. Wood:
This is to confirm in writing what has been discussed verbally. We are hereby rejecting the
variance application submitted for the location of septic and stormwater detention on property
zoned Rural Areas to serve the Shadwell Market redevelopment. This variance request does
not meet the definition of "variance" as stated in Section 15.2-2201 of the Code of Virginia.
The issue in this case is based on a determination of permitted uses and not on the location
of structures. As stated in the Code, "It (a variance) shall not include a change in use which
change shall be accomplished by a rezoning or by a conditional zoning. The appeal of this
determination of use will be heard by the Board of Zoning Appeals on July 9th
If you are aggrieved by this determination, you have the right to appeal it within thirty (30)
days of the date notice of this determination is given, in accordance with Section 15.2-2311 of
the Code of Virginia. If you do not file a timely appeal, this determination shall be final and
unappealable. An appeal shall be taken only by filing with the Zoning Administrator and the
Board of Zoning Appeals a notice of appeal which specifies the grounds for the appeal. In
order for an appeal to be considered complete, it shall include a completed application and
$95 fee. The date notice of this determination was given is the same as the date of this
letter.
