Many additions have been made to the property since its creation in 1740. The present request includes the demolition and rebuilding of the kitchen to make it visually more attractive, safer, and more modern inside while retaining the historic look outside. The additional building shown on Drawing"3" is a proposed new cottage which is conforming and, while not included in this request, is shown for perspective purposes. The kitchen as it currently stands is highlighted in green in Drawing"1". The 50 foot setback line from the residential area will apply as soon as the present kitchen is demolished, prohibiting building of the proposed new kitchen, shaded in orange in Drawing"2," on the same footprint,even though parts of the non-conforming building will be demolished and never rebuilt, shaded in red. Drawing"3" depicts the variance being sought for the rebuilding of the kitchen within the footprint of the present kitchen,but encroaching on the 50' setback(the pie- shaped piece shaded in blue)The remainder of the kitchen is conforming. 1)The Inn is badly in need of a new kitchen. The present kitchen is on two levels with a narrow passage and stone stairs between the cooking area and the dishwashing area. Employees have fallen and the owner had surgery for torn cartilage due to a fall down the stairs.The proposed kitchen would be on one level. The noisy freezer is outside. It and the refrigerator would be contained within the new building. A copy of the proposed kitchen floor plan is attached to show the placement of the refrigerator and freezer. Strict application of the setback to the small nonconforming piece would be an undue hardship in that a remodeling of the present kitchen would not eliminate the narrow dangerous steps between the two levels, and there is no other area the kitchen can be built to service the dining rooms while retaining the historic look of the property. 2)Although the hardship is probably shared by other properties within the same vicinity, in reality there are probably no properties within the district to which the commercial setback requirements apply. 3)Not only will the granting of the requested variance not be a detriment to adjacent property,because the freezer will be located inside and the nonconforming footprint of the new kitchen substantially smaller, but the character of the district will not be changed.
