Ray, LS Land Planners Francis MacCall October 19, 2015 County of Albemarle Department of Community Development & Zoning 401 McIntire Road Charlottesville, Virginia 22902 (434) 296-5832 phone (434) 972-4126 fax RE: Waiver of Section 14-404.A (T.M. 30-9B1) On behalf of the property owner, and in accordance with Section 14-203.1 & 14.404.D of the Subdivision Ordinance, I am requesting a waiver of the strict requirement of Section 14-404.A, that requires access to the building site from only one street, shared driveway, or alley established at the same time of the original subdivision, and shall have no immediate access onto any other public street. A small triangular Boundary Line Adjustment would be made with T.M. 30-36B, giving Parcel 9B1 thirty feet of frontage on State Route 662. This frontage would be used as access to the building site on the new Lot 3B by way of a short driveway from State Route 662. Requiring both lots to use the same access from State Route 665 would not be practical for the following reasons. 1. The existing access to Parcels 9B and 9B1 would need to be upgraded to a three to five lot Private Street with a 20 foot wide paved road. 2. A new Two Lot Private Street and driveway would need to be constructed through Parcel 9B1 and Lot 3B (approximately 1000 feet) to access the building site on Lot 3B. 3. The new Two Lot Private Street and driveway would require clearing, grubbing and grading of a driveway through a forested area. 4. The new Two Lot Private Street and driveway would require crossing a 200 foot wide stream buffer. - YTIVIUMMOC :14 M9O.]3VA 1 Requiring Lot B3 to use the existing private street will create unnecessary clearing and grubbing, soil erosion, water quality, stormwater runoff & disturbance in a sensitive stream buffer. Dennis Seale of VDOT has visited the site with the owner and approved the proposed location onto State Route 662 as having adequate sight distance. Please see attached Exhibit A, dated October 13, 2015, showing proposed Lot B3 with access to State Route 662 and the possible location of a New Two Lot Private Street Easement through the Residue of Parcel 9B1. I believe situations like this are the reason for allowing a waiver of Section 14-404.A and we are looking forward to your approval of this request.
