Please correct any reference to the Tax Map and Parcel Number on the Plat. This comment has been addressed. 2. [14-302 (A)(3)] Please include any instrument reference for Louisa Rd. This comment has been addressed. 3. [14-302(A)(4)(5) and 14-303(E)] Please indicate whether the proposed 30' access easement is public or private. Please update the callout label on the Plat accordingly. a. Easements shown for private streets, alleys and shared driveways shall be labeled as "private street easement", "alley easement" or "shared driveway easement." The easement holder(s) shall be identified on the plat. b. Is it correct that this 30' easement will be abutting another 30' easement depicted on the Plat showing subdivision of TMP 66-1OJA (SUB202100098)? Will these private streets have separate entrances? Please make sure this information is clear in each respective access and maintenance agreement. Proposed entrances may not meet VDOT spacing requirements. These comments have been addressed. 4. [14-306,14-317] If a private street is proposed, provide a maintenance agreement for review by the County Attorney. A private street maintenance agreement template is attached below. Please see the County Attorney's suggested revisions to the maintenance agreement below. Submit a signed copy of the updated agreement along with the Plat once they are both ready for approval. When the Plat is signed and approved, record the signed maintenance agreement along with the Plat. 5. [14-309 & 14-3101 Soil evaluations & Health director approval of septic systems. The soils evaluations have been forwarded to the Department of Health for review. This Plat requires Department of Health approval prior to final County approval. This comment has been addressed. 6. [14-308.1] A Tier II Groundwater Assessment has been initiated for this application. Results of the assessment are attached. Results have been shared with the Applicant. [14-302(B)(8) and 18-10.41 Please include the yards as described in Section 10.4. Front (existing public roads): 75 feet Front (internal public or private road): 25 feet Side: 25 feet Rear: 35 feet Maximum structure height: 35 feet Please include these setbacks as a Note. Setbacks are measured from property lines and not easement lines. Please revise the setback lines as shown on the Plat. This comment has been addressed. 8. [14-302(B)] Please add a date of last revision. This comment has been addressed. 9. [14-302(A)(10)] According to the Plat recorded in Deed Book 5471 page 643 the property TMP 66-IOJB has three (3) theoretical development rights. Please assign the additional development right to either Lot C or the residue. Please be aware that based on the proposed acreages neither of these properties will be able to be further divided. This comment has been addressed. 10. [14-316] VDOT approval of proposed entrance onto Louisa Road is required prior to plat approval. This comment has been addressed. Office of the County Attorney — Andy Herrick, aherrick@albemarle.org — Review comments below. 1. The word "day" should be added to "this 21st day of SEPTEMBER, 2021" in the opening recitals. 2. At the end of the recitals, the obligations are being imposed upon both Lot B or C and the respective Residue lots. 3. Section I describes the road's condition as " 10-foot wide of VDOT 21 B." Please revise to something like "a 10-foot wide road maintained to VDOT 21B standards." 4. The signature lines should have Virginia Land, LLC above the lines, and the name and title of the individual signatory below the lines. These comments have been addressed.
