Don't know if John responded to this yet so I will. Charles Baber at VDOT approved our driveway and issued us permit# 743 -8012. His number is 293 -0011 Ext. 114. If you wouldn't mind forwarding the plat as your wording to him will probably make more sense than mine. I'm of course happy to do whatever it takes to move this along and will contact our attorney for another letter that will hopefully use the right wording. I'll let Ed Bains figure that one out as he should be able to decipher the code these County people talk in. I guess the email I sent to Megan yesterday prompted this response. (see below) Who at VDOT approved your entrance? A copy of the plat needs to be sent to VDOT so that they can send approval to the county. I will be happy to forward the plat to VDOT if you let me know who to address it to. They also have specific wording that needs to be in the road maintenance agreement. I believe your attorney will be aware of this. If you have any questions, please do not hesitate to contact me. The referenced plat was submitted for review as a boundary adjustment plat. On October 19, 2007 Megan Yaniglos commented that the plat could not be approved as a boundary line adjustment because the residue of Parcel 31 lacked sufficient frontage. You have submitted a revised plat that shows Parcels 31 and 33 being served by a new 150 — long and 50- foot and variable width private access easement. This access easement provides the frontage required for this transaction by sections 18 -10.4 and the lot width required by section 18- 4.6.1.c. The Agent for the Subdivision Ordinance has determined that a plat that meets the definition of a boundary adjustment but also shows either a shared driveway or a private street serving two parcels shall also be reviewed for the criteria set forth in section 206 (B) that pertain to these shared driveways or streets. Such a plat is subject to conditions that include the approval of the entrance by VDOT, the certification that the two -lot private street meets the standards of section 14- 412.A.1, the provision of a maintenance agreement, and conformance to section 404. The term "subdivision" means any division of land, and includes resubdivisions, rural subdivisions, family subdivisions, and the establishment of a condominium regime. For purposes of this chapter, a boundary line adjustment is also a "subdivision." 14 -206 Subdivisions other than rural subdivisions, family subdivisions and boundary line adjustments. The following sections of this chapter shall apply to each subdivision other than rural subdivisions, family subdivisions and boundary line adjustments: B. Subdivisions that would result in two (2) lots in the rural areas For subdivisions that would result in two (2) lots in the rural areas, the following sections shall apply: 1. In addition to the minimum design requirements set forth in section 14 -410, the following minimum design requirements shall apply to private streets authorized by this chapter: A. Residential private streets. Each private street serving residential uses authorized under sections 14 -232 or 14 -233 shall satisfy the following: 1. Streets serving two lots. Each private street serving two (2) lots shall satisfy the following: (i) easement or right -of -way widths shall be thirty (30) feet minimum; (ii) the required materials and minimum depth of base shall satisfy the minimum requirements described in the design standards manual; and (iii) the surveyor shall include the following wording on the final plat: "The existing and /or proposed right -of -way is of adequate width and horizontal and vertical alignment to accommodate a travelway passable by ordinary passenger vehicles in all but temporary extreme weather conditions, together with area adequate for maintenance of the travelway, as required by section 14 -412 of the Albemarle County Code."
